AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
AUBURN, WASHINGTON, AMENDING ORDINANCE NO. 5436
BY AUTHORIZING THE MAYOR TO SIGN A LOCAL AGENCY
SUPPLEMENTAL AGREEMENT BETWEEN THE CITY AND
THE WASHINGTON STATE DEPARTMENT OF
TRANSPORTATION, APPROVING FEDERAL TEA-21 FUNDS
TO PREPARE AND IMPLEMENT THE SR18/C STREET SW
RAMP MODIFICATIONS/3rd STREET SW GRADE SEPARATION
PROJECT, PR 529
WHEREAS, the City Council of the City of Auburn must adopt and
approve all appropriations by Ordinance pursuant to Chapter 35A.33 RCW; and
WHEREAS, Ordinance Nos. 5118, 5266, 5376 and 5436 passed July
22, 1998, July 19, 1999, April 17, 2000, and October 2, 2000, respectively,
authorized the Mayor and City Clerk to execute a Local Agency Agreement and
necessary supplements in the amount of $18,828,847 of Federal TEA-21
funding for the design, right-of-way acquisition, and construction of the 3rd
Street SW Grade Separation Project (PR 529); and
WHEREAS, in the Federal Fiscal Year 2003, allocation for
Demonstration funds was revised to $3,079,003 which is an increase of
$50,156 of federal funding for the project; and

WHEREAS, the existing Local Agency Agreement must be
supplemented to obligate this additional funding.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, DO ORDAIN AS FOLLOWS:
Section 1. Purpose. Auburn City Ordinance No. 5436, passed
October 2, 2000, is hereby amended to reflect acceptance of $50,156 in federal
Demonstration TEA-21 funds and hereby authorizes the Mayor and City Clerk
to execute the Local Agency Supplemental Agreement between the City and
the Washington State Department of Transportation, a copy of said
Supplemental Agreement is attached hereto as Exhibit "A" and is incorporated
herein by reference. The Mayor and City Clerk are hereby authorized to
approve and execute any future supplemental agreements thereto required for
completion of phases of the project, including but not limited to design, right-of-
way, and construction and limited to the total amount of $18,879,003.
Section 2. Severability. The provisions of this ordinance are
declared to be separate and severable. The invalidity of any clause, sentence,
paragraph, subdivision, section or portion of this ordinance, or the invalidity of
the application thereof to any person or circumstance shall not affect the validity
of the remainder of this ordinance, or the validity of its application to other
persons or circumstances.

Section 3. Implementation. The Mayor is hereby authorized to
implement such administrative procedures as may be necessary to carry out
the directions of this legislation.
Section 4. Effective date. This ordinance shall take effect and be in
force five (5) days from and after its passage, approval, and publication, as
provided by law.
