AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
AUBURN, WASHINGTON, DECLARING PUBLIC USE AND
NECESSITY REGARDING THE CITY OF AUBURN
DOWNTOWN PARKING FACILITIES, AND AUTHORIZING
CONDEMNATION
WHEREAS, the City of Auburn is involved in a project to make certain
improvements to City of Auburn Downtown Parking facilities (the Project); and,
WHEREAS, efforts have been made to obtain properties which need to be acquired
in connection with the project, including having the property appraised and trying to
negotiate reasonable amounts of compensation to be paid for the property to be acquired;
and,
WHEREAS, those efforts have not been successful in securing the acquisition of all
of the property necessary for the Project; and,
WHEREAS, although the owner of the subject property has expressed interest in
obtaining a new appraisal, passage of this ordinance will allow the City to continue moving
forward with the condemnation process while a new appraisal is being obtained; and
WHEREAS, because of the importance of the City of Auburn Downtown Parking
facilities as a part of the City's infrastructure system, and because the improvements are
necessary to complete the project, and because of the importance of the improvements to
be made, the property to be acquired is necessary for the project and for completion of the
public uses of the project.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON DO ORDAIN as follows:

1. That the property identified herein is necessary for the City of Auburn
Downtown Parking facilities, and have a public use in connection with the
improvements to be made to the Project.
2. That the Mayor and/or designee(s) is/are authorized to commence
condemnation action to acquire the property identified as follows:
That certain property generally located at 128 A Street NW, in Auburn,
Washington, 98002 and legally described as follows:
LOT 18 AND THE NORTH 17.5 FEET OF LOT 17, BLOCK 5,
BALLARD'S LW PARK TO SLAUGHTER, TOGETHER WITH THE
VACATED 10 FT STRIP OF RIGHT-OF-WAY ADJACENT
THERETO, LOCATED IN AUBURN, KING COUNTY, WASHINGTON
and to take such other action and/or implement such other administrative
procedures as may be necessary to carry out the directives of this legislation.
3. That the compensation to be paid to the owners of the property to be
acquired by the condemnation action shall be paid from the General Fund of the
City.
4. That if any provision of this Ordinance or its application to any person or
circumstance is held invalid, the remainder of this Ordinance or the application of
the provision to other persons or circumstances shall not be affected.
5. That this Ordinance shall be in full force and effect five (5) days after
publication, as required by law.
