AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF AUBURN, WASHINGTON, REPEALING CHAPTER 2.39
OF THE AUBURN CITY CODE RELATING TO THE
AIRPORT ZONING COMMISSION
WHEREAS, the City of Auburn operates a municipal airport; and,
WHEREAS, Section 14.12.070 of the Revised Code of Washington (RCW)
provides for the establishment of an airport zoning commission to recommend
boundaries of the various airport hazard zones to be established and the regulations to
be adopted; and,
WHEREAS RCW 14.12.070 (2) states that where a city planning commission or
comprehensive zoning commission already exists, it may be appointed as the airport
zoning commission; and,
WHEREAS, the City of Auburn has a planning commission that is charged with
developing regulations related to zoning, including those affecting the airport, and thus
functions as the airport zoning commission on such matters; and
WHEREAS, the Airport Zoning Commission has not, for many years, functioned
as the commission under the statute under which it was established, and is therefore no
longer needed as a stand-alone commission.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON DO ORDAIN AS FOLLOWS:
Section 1. Code Chapter Repealed. Chapter 2.39 of the Auburn City Code is hereby
repealed.
Section 2. Administrative Authority. The Mayor is hereby authorized to implement
such administrative procedures as may be necessary to carry out the directives of this
legislation.

Section 3. Severability. If any provision of this ordinance or its application to any
person or circumstances is held invalid, the remainder of the act of the application of the
provision to other persons or circumstances shall not be affected.
Section 4. Effective date. This ordinance shall take effect and be in force five (5) days
after passage and publication as required by law.

Duties.
2.39.010 Created.
There is created and established an airport zoning commission for the city,
pursuant to RCW 14.12.070. (1957 code § 1.15.010.)
2.39.020 Membership - Appointment and removal.
The airport zoning commission shall consist of five members, all of whom shall
serve without compensation. The commission members shall be appointed by the
mayor with the consent of the city council. In case any vacancy should occur in the
membership of the zoning commission for any cause, the mayor shall fill the vacancy by
making an appointment, with the consent of the council. The members of the board may
be removed by the mayor, subject to the approval of the council, for such causes that
he deems sufficient. (1957 code § 1.15.020.)
2.39.030 Duties.
The airport commission shall recommend the boundaries of the various zones to be
established and the regulations to be adopted in the operation of the Auburn Municipal
Airport, as authorized by Chapter 14.12 of the Revised Code of Washington. (Ord. 2831
§ 1, 1974; 1957 code § 1.15.030.)
