AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF AUBURN, WASHINGTON, AMENDING SECTIONS
10.36.205, 10.36.255 AND 10.36.360, OF THE AUBURN
CITY CODE, RELATING TO PARKING ENFORCEMENT
WHEREAS, among the municipal responsibilities with which the City of Auburn is
charged are those involving parking enforcement; and
WHEREAS, parking enforcement is necessary to promote business activity by
providing customer parking, and parking opportunities for persons working in the
parking enforcement areas of the City; and
WHEREAS, with respect thereto, and in order to adequately avail enforcement
tools, it is appropriate to clarify which code provisions the violation of which could
implicate towing of vehicles illegally parked; and
WHEREAS, it is also appropriate to amend Section 10.36.255 ACC, Obstructing
post office boxes prohibited, to clearly provide that the prohibition applies at all times
except when mail is being deposited or picked up; and
WHEREAS, it is also appropriate to amend Section 10.36.205 to specify that not
only is it illegal to stop or park a vehicle on city streets with improper license plates, it is
also illegal to stop or park a vehicle on city streets with improper license plate tabs.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, DO ORDAIN AS FOLLOWS:
SECTION ONE, CODE AMENDMENT.
Section 10.36.205 of the City of Auburn Code is amended to read as follows:

10.36.205 Parking in unlicensed vehicle.
A. It is a violation of this section to stop, stand or park a vehicle on a street,
highway, alley or public property within the city limits of the city unless such vehicle
possesses a proper and current vehicle license plate or plates, and such plate or plates
are properly mounted thereon in accordance with the State of Washington Department
of Licenses rules and regulations.
B. It is a violation of this section to stop, stand or park a vehicle on a street,.
highway, alley or public property within the city limits of the city with switched license
plates or switched license plate TABS (license plates/TABS belonq on another vehicle).
C. It is a violation of this section to stop, stand or park a vehicle on a street,
highway, alley or public property within the city limits of the city without current, properly
displayed month and year license TABS.
D. Penalty. Any violation of this section shall be an infraction and punishable by a
monetary penalty of $86.00. (Ord. 5724 § 2, 2002; Ord. 5212 § 1 (Exh. F), 1999; Ord.

SECTION TVVO. CODE AMENDMENT.
Section 10.36.255 of the City of Auburn COde is amended to read as follows:
10.36.255 Obstructing post office boxes prohibited.

SECTION THREE. CODE AMENDMENT.
Section 10.36.360 of the City of Auburn Code is amended to read as follows:
10.36.360 Violation - Penalty.
Any vehicle parked in violation of ACC 10.36.190 ~'""~ ~n '~'~50 throurlh
10 ....... 10.36.520 may be impounded by the chief of police of the city, and the cost of
such impounding shall be paid by the owner or operator of such vehicle before the
same is released, and any motor vehicle owner or operator who violates any of the
terms of ACC 10.36.190(B), (C), (D) or (E) has committed an infraction and shall pay a
fine of $50.00. Any motor vehicle owner or operator who violates any of the terms of
ACC 10.36.250 through 10.36.350, except ACC 10.36.205 and 10.36.265, has
committed an infraction and shall pay a fine of $30.00 within 15 days from the date of

issuance of such notice, or in the sum of $40.00 if paid after the fifteenth day from the
issuance of such notice. Fines shall be paid directly to the Auburn municipal court. (Ord.

SECTION FOUR. GENERAL SEVERABILITY.
If any provision of this Ordinance or the application thereof to any person or
circumstance is held to be invalid, the remainder of such code, ordinance or regulation
or the application thereof to other person or circumstances shall not be affected.
SECTION FIVE. IMPLEMENTATION.
The Mayor is hereby authorized to implement such administrative procedures as
may be necessary to carry out the directives of this legislation.
SECTION SIX. EFFECTIVE DATE.
This Ordinance shall be in full force and effect five (5) days after publication of
the Ordinance Summary.
