HomeMy WebLinkAbout5870 ORDINANCE NO.5 8 7 0 AN ORDINANCE OF THE CITY COUNCil OF THE CITY OF AUBURN, WASHINGTON, AMENDING SECTIONS 2.03.040, 2.63.110, 2.63.113, 2.63.180 AND 2.63.190 OF THE AUBURN CITY CODE, AND REPEALING SECTIONS 2.63.111 AND 2.63.112 OF THE AUBURN CITY CODE, RELATING TO APPOINTED OFFICIAL lEAVES WHEREAS, the current provisions of the Auburn City Code provide for accrual rates of leave for appointive officials of the City; and WHEREAS, some of the provisions of the City Code are inconsistent in what they provide; and WHEREAS, in order to reconcile these inconsistent provisions, it is appropriate that the City Code be modified as set forth below. NOW, THEREFORE, THE CITY COUNCil OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS FOllOWS: Section 1. AMENDMENT TO SECTION OF CITY CODE: That a Section 2.03.040 of the Auburn City Code is created to read as follows: 2.03.040 Appointment of Appointive appointive powerofficers. The mayor shall appoint, and at his pleasure may remove, all city appointive officers, subject to the provisions of any applicable law, rule or regulation pertaining to civil service, state law or city ordinances. This appointive authority applies to actinÇ1, interim and permanent appointive officers. Appointive officers are· as follows: airport supervisor, city attorney, assistant city attorney, acting city attorney, city clerk, deputy city clerk (2), city engineer, executive assistant to the mayor, finance director, hearing examiner, human resourcec director, p::uks and recreation director, planning and community development director, public works director, police chief, assistant police chief, fire chief and assistant fire chief. A. Department Directors: City Attorney. Finance Director. -------------------------------------- Ordinance No. 5870 September 13, 2004 Page 1 Human Resources/Risk Management Director, Information Services Director Parks and Recreation Director, Planning and Community Development Director, Public Works Director, Police Chief, Fire Chief. B. Assistant Department Director positions: Assistant City Attorney, Assistant Police Chief, Assistant Fire Chief, City EnQineer. C. Administrative Employees: Administrative Secretary (Mayor & City Council's Office) Economic Development Manager, Executive Assistant to the Mayor, InterQovernmental Services Coordinator. It is provided, however, that appointment of the Bity-City attorney Attorney shall be subject to confirmation by a majority of the members of the Bity-City councilCouncil. AMENDMENT TO SECTION OF CITY CODE: That a Section 2.63.110 of the Auburn City Code is created to read as follows: 2.63.110 Vacation - Longevity leave time - General employees. Effective January 1, 1981, fullFull-time employees of the city, excluding employees designated in ACC 2.63.113 and excluding employees covered by a collective bargaining agreement, shall be entitled to vacation - longevity leave time according to the following schedule: From 0 years throuQh -4 full years! of continuous service, 12 days per year; StartinQ in the 5th year -throuQh 9 full years! of continuous service, 15 days per year; StartinQ in the 10!b. -year through 14 full years! of continuous service, 18 days per year; StartinQ in the 15th year throuQh 20 full years! or moreof continuous service, 20 days per year~ More than 20 full years of continuous service, 22 days per year. AMENDMENT TO SECTION OF CITY CODE: That a Section 2.63.113 of the Auburn City Code is created to read as follows: 2.63.113 Vacation - Longevity leave time - Department headsdirectors. -------------------------------------- Ordinance No. 5870 September 13, 2004 Page 2 A. Effective January, 1989, tIhe following designated employees, hereinafter referred to as department headsdirectors, shall accrue vacation - longevity leave time at the rate of 20 days per year: 1. City attorneyThe Department Directors listed in Section 2.03,040(A) of the City Code; 2. Fire chief;The Municipal Court JudQe 3. Director of finance department; 4. Director of parks and recreation department; 5. Director of personnel department; 6. Director of planning and community development; 7. Director of public works department; 8. Police chief. B. Longevity leave to the employees designated herein, shall accrue as follows: 1. During the first calendar year of employment with the city, each of the above designated department head directors would be entitled to a block of up to 20 days of vacation - longevity leave. The actual number of days shall be computed based upon the date on which the above listed department Maddirectors commenced employment with the city; 2. During the second year of employment with the city and each year thereafter, each department Rea4-director will accrue vacation - longevity leave on a monthly basis, to a maximum of 20 days per year. (Ord. 4320 § 2, 1989.) Section 4. AMENDMENT TO SECTION OF CITY CODE: That a Section 2.63.180 of the Auburn City Code is created to read as follows: 2.63.180 Military leave. Military Leaveleave, not to exceed 15 calendar days in any period of 12 consecutive months as provided in Section 38.40.060 RCW, over and above annual vacation or sick leave, may be allowed any employee who is a member of the National Guard or reserve corps. The employee shall be paid his regular salary from the city for the period of his military leave. (1957 code § 1.26.040.) Section 5. AMENDMENT TO SECTION OF CITY CODE: That a Section 2.63.190 of the Auburn City Code is created to read as follows: 2.63.190 Leave without pay and unauthorized absences. A:-No leave without pay will be granted an employee until the employee has first taken advantage of all his usable earned vacation credits, and such leave will not be granted for the purpose of the employee gaining personal advantage or profit. B. Unauthorizod absence from duty for three consecutive working days shall constitute grounds for dismissal at the discretion of the city council. REPEAL OF SECTION OF CITY CODE: That a Section 2.63.111 of the Auburn City Code is repealed. Section 5. REPEAL OF SECTION OF CITY CODE: That a Section 2.63.112 of the Auburn City Code is repealed. Section 6. IMPLEMENTATION: The Mayor is hereby authorized to implement such administrative procedures as may be necessary to carry out the directives of this leg islation. Section 7. CONSTITUTIONALITY OR INVALIDITY: If any section, subsection, clause, phrase, or sentence of this Ordinance, is for any reason held to be invalid or unconstitutional, such invalidity or unconstitutionality of the remaining portions of this ordinance, as it is being hereby expressly declared that this ordinance and each section, subsection, clause, phrase, or sentence, hereof would have been prepared, proposed, adopted, and approved and ratified irrespective of the fact that anyone or more section, subsection, clause, phrase, or sentence, be declared invalid or unconstitutional. Section 8. EFFECTIVE DATE: This ordinance shall take effect and be in force five (5) days from and after its passage, approval, and publication, as provided by law. Effective January 1, 1981, administrati'.'e personnel in the city's police department shall be entitled to longevity leave time according to the following schedule: o 5 years' continuous service, 14 days per year; 6 10 years' continuous service, 17 days per year; 11 15 years' continuous service, 20 days per year; 16 20 years' continuous service, 22 days per year; Over 21 years' continuous service, 24 days per year. (Ord. 3760 § 1, 1982; Ord. 3563 § 3, 1980.) 2.63.112 Vacation Longevity leave time Fire administrative employees. Effective January 1, 1981, administrative personnel in the city's fire department shall be entitled to longevity leave time according to the following schedule: o 5 years' continuous service, 14 days per year; 6 10 years' continuous service, 18 days per year; 11 15 years' continuous service, 20 days per year; 16 20 years' continuous service, 22 days per year; Over 21 years' continuous service, 24 days per year.
