HomeMy WebLinkAbout5879 ORDINANCE NO.5 8 7 9 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, AMENDING SECTIONS 2.33.020, 2.36.030, 2.45.010, AND 2.69.040 OF THE AUBURN CITY CODE, RELATING TO TERMS FOR BOARD AND COMMISSION MEMBERS WHEREAS, the current provisions of the Auburn City Code (ACC) provide for different lengths of the term for members of City boards and commissions; and WHEREAS, in order to bring some uniformity to the various boards and commissions of the City, except where the term is specified by state law, it would be advantageous to have all terms of boards and commissions uniformly set at three years for commissioners and board members appointed after December 1, 2004. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. AMENDMENT TO CITY CODE: That Section 2.33.020 of the Auburn City Code is amended to read as follows: MUNICIPAL AIRPORT ADVISORY BOARD 2.33.020 Appointment - Terms. Immediately upon appointment, the members designated to act on the board shall assemble for organization, and for convenience of business transactions shall elect a chairman and secretary whose duties shall be the duties indicated by such designation. The term of office for the board members shall be set up to five years from the date of appointment. provided that the term of office for any board members appointed or re-appointed after December 1. 2004. shall be set UP to three years from the date of appointment or re-appointment. The city council shall be empowered to originally appoint one member for one year, one member for two years, one member for three years, one member for four years and one member for five years. All appointees will serve until successors are appointed and qualified. Members of the board shall be subject to removal in accordance with the provisions of Chapter 2.30 ACC as it currently exists or as it may be amended hereafter. No board member shall have business -------------------------------------- Ordinance No. 5879 November 8, 2004 Page 1 interests at the airport, other than the standard hangar or tie-down rental. AMENDMENT TO CITY CODE: That Section 2.36.030 of the Auburn City Code is amended to read as follows: HUMAN SERVICES COMMITTEE 2.36.030 Appointment - Terms. There shall be 11 persons appointed to the city human services committee and said persons shall serve for staggered terms of five years. provided that the term of office for any committee members appointed or re-appointed after December 1. 2004. shall be three years from the date of appointment or re-appointment. (Ord. 4672 § 1, 1994; Ord. 4488 § 1,1991; Ord. 3009 § 4,1975.) Section 3. AMENDMENT TO CITY CODE: That Section 2.45.010 of the Auburn City Code is amended to read as follows: PLANNING COMMISSION 2.45.010 Membership - Term of office. The city planning commission shall consist of seven members to be appointed by the mayor and confirmed by the city council. Members shall serve for a period of six years and expiration shall be designated to provide the fewest possible terms will expire in anyone year. provided that the term of office for any committee members appointed or re-appointed after December 1, 2004. shall be three years from the date of appointment or re-appointment. The planning commission will have such duties and responsibilities as set forth in Chapter 35A.63 RCW as amended. Copies shall be on file with the city clerk and made available at the public's request, the number in such manner as required by law. (Ord. 4676 § 1,1994; 1957 code § 1.10.020.) Section 4 AMENDMENT TO CITY CODE: That Section 2.69.040 of the Auburn City Code is amended to read as follows: CITY OF AUBURN LIBRARY BOARD 2.69.040 Board of commissioners - Terms. The five library commissioners presently serving shall complete their current terms of office. The length of service of the additional two commissioners, appointed under the terms of the ordinance codified in this section, shall be determined by lot as to whose term will expire in two and four years respectively. Their terms shall begin after their -------------------------------------- Ordinance No. 5879 November 8, 2004 Page 2 appointment has been approved by the city council. Terms of office for all commissioners, at the expiration of their initial term, shall become five-year terms... provided that the term of office for any committee members appointed or re-appointed after December 1. 2004, shall be three years from the date of appointment or re- appointment. No commissioner shall serve more than two consecutive fi.v.ethree-year terms. (Ord. 5599 § 1,2001.) Section 5 IMPLEMENTATION: The Mayor is hereby authorized to implement such administrative procedures as may be necessary to carry out the directives of this legislation. Section 6 CONSTITUTIONALITY OR INVALIDITY: If any section, subsection, clause, phrase, or sentence of this Ordinance, is for any reason held to be invalid or unconstitutional, such invalidity or unconstitutionality of the remaining portions of this ordinance, as it is being hereby expressly declared that this ordinance and each section, subsection, clause, phrase, or sentence, hereof would have been prepared, proposed, adopted, and approved and ratified irrespective of the fact that anyone or more section, subsection, clause, phrase, or sentence, be declared invalid or unconstitutional. Section 7 EFFECTIVE DATE: This ordinance shall take effect and be in force five (5) days from and after its passage, approval, and publication, as provided by law.
