HomeMy WebLinkAbout5976 ORDINANCE NO. 5 9 7 6 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON CREATING A NEW CHAPTER 3.98 OF THE AUBURN CITY CODE RELATING TO AMBULANCE TRANSPORT WHEREAS, pursuant to the authority provided in section 35.27.370, the City is authorized to operate an ambulance service and to make charges for such service; and WHEREAS, in order to meet the needs of the citizens for ambulance services, particularly where they may not be as available from outside service providers, it is appropriate for the City to formally implement procedures for such a service, as through this ordinance. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN as follows: Section 1. New Chapter to City Code. That a new chapter 3.98 of the Auburn City Code, be, and the same is hereby created to read as follows: Chapter 3.98 AMBULANCE TRANSPORT Sections: 3.98.010 3.98.020 3.98.030 3.98.040 Ambulance transport rates. Authority to promulgate regulations. Billing functions and services. Violation - Penalty. 3.98.010 Ambulance transport rates. The following rates are established for ambulance transports performed by the City of Auburn: Ordinance No. 5976 December 13, 2005 Page 1 of 3 Fire Ambulance transport fee: Fire Ambulance transport mileage: $658.00 base rate $13.50 per mile Rates may be amended from time to time by resolution of the City Council, as a part of the City's Fee schedule. A copy of current rates shall be maintained by the City Clerk. 3.98.020 Authority to promulgate regulations. The Mayor is hereby authorized to promulgate any and all regulations necessary to implement the provisions of this Chapter, including without limitation requirements for billing, payment, collections, and penalties for delinquent payments. 3.98.030 Billing functions and services. The Mayor is authorized to perform billing services necessitated through passage of the Ordinance codified in this Chapter by using city staff; provided, however, the Mayor is hereby given express authority to enter into agreements with other governmental jurisdictions or private companies for the provision of ambulance billing services. 3.98.040 Violation - Penalty. A. It is a civil infraction for any person to fail to pay charges assessed in accordance with this chapter or to violate a provision or regulation adopted under authority of this chapter. B. Each such person is deemed to have committed a separate offense for each and every day or portion thereof during which a violation of any of the provisions of this chapter is committed, continued, or permitted. C. A person convicted of a violation of the provisions of this section is guilty of a Class 1 civil infraction. Section 2. Implementation. The Mayor is hereby authorized to implement such administrative procedures as may be necessary to carry out the directions of this ordinance, including procedures necessary to implement programs for charitable fee reductions and for resident - insurance fee accommodations, pursuant to applicable regulations and as guided by the Opinion of the U.S. Office of Inspector General (OIG) No. 01-11. If any portion of this Ordinance or its application to any person or circumstances is held invalid, the remainder of the Ordinance or the application of the provision to other persons or circumstances shall not be affected. Section 4. Effective Date.
