AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF AUBURN, WASHINGTON, DECLARING PUBLIC USE
AND NECESSITY REGARDING DOWNTOWN PARKING
FACILITIES, AN EXPANDED DOWNTOWN TOWN
CENTER PLAZA AND A CITY HALL ANNEX, AND
AUTHORIZING CONDEMNATION
WHEREAS, the City of Auburn is involved in a project to provide for a City
Hall Annex, to expand the Downtown Town Center Plaza and to make certain
improvements to City of Auburn Downtown Parking facilities (combined as the
Project); and,
WHEREAS, efforts have been made to obtain property needed in
connection with the project, including having the property appraised and trying to
negotiate reasonable amounts of compensation to be paid for the property to be
acquired; and,
WHEREAS, while on-going, those efforts have not been successful at this
point in time in securing the acquisition of all of the property necessary for the
Project; and,
WHEREAS, although there may be interest by the owner(s) of the subject
property to work toward agreement(s) whereby the City may acquire the
property, passage of this ordinance will allow the City to continue moving forward
with the condemnation process while the negotiation process is pursued; and
WHEREAS, the current Auburn City Hall building was built in 1979, and
because of the growth of the City since then, and the corresponding increase in
needed City services, the office space at the current City Hall is inadequate to

house existing employees, so that the City has to lease other office space for
some City employees; and
WHEREAS, The City Council recently passed its resolution No. 3985,
stating its support for a Downtown Town Center Plaza concept, which Resolution
and its findings are incorporated herein by this reference; and
WHEREAS, because of the need for a City Hall Annex, and the need for
an expanded Downtown Town Center Plaza, and because of the importance of
the City of Auburn Downtown Parking facilities as a part of the City's
infrastructure system, and because the improvements are necessary to complete
the project, and because of the importance of the improvements to be made, the
property to be acquired is necessary for the project and for completion of the
public uses of the project.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON DO ORDAIN as follows:
Section 1. Declaration of Necessity. That the property identified herein
is necessary for the City of Auburn City Hall Annex, for an expanded Downtown
Town Center Plaza and for additional Downtown Parking facilities, and have a
public use in connection with the improvements to be made to the Project.
Section 2. Authorization for Condemnation. That the Mayor and/or
designee(s) is/are authorized to commence condemnation action to acquire the
property identified as follows:

That certain property generally located at the Northeast Corner of the
Intersection of East Main Street and North Division, in Auburn, Washington, and
legally described as follows:
Parcel One
Lot 4 in Block "0" of the First Edition to the Town of Slaughter, as per the
plat recorded in Volume 2 of Plats, page 84, records of King County,
Washington, EXCEPT that portion conveyed to Yale investment company, a
corporation, by the deed recorded under auditor's file number 2601863, records
of King County, Washington, more particularly described as follows:
Beginning at the southeast corner of said lot; running thence northerly
along the east line of said lot to the northeast corner of said lot; thence west
along the north line of said lot, 16.75 feet to a point in the centerline of a concrete
wall; thence south along the centerline of said concrete wall, to a point in the
south line of said lot, which is 16.53 feet west of the point of beginning; thence
east along said south line of said lot, 16.53 feet to the point of beginning, situate
in the City of Auburn, King County, State of Washington
Parcel Two
Part A: The east 16 feet and 6 inches of Lot 4, Block "0"
Part B: The west 1/2 of Lot 3, Block "0"
All in the First Edition to the Town of Slaughter, as per the plat recorded in
Volume 2 of Plats, page 84, records of King County, situate in the City of Auburn,
County of King, State of Washington, commonly known as 9 East Main Street,
Auburn, Washington
Parcel Three
The west half of Lot 2, Block "0", Ballard's First Edition to the Town of
Slaughter, according to the plat thereof recorded in Volume 2 of Plats, page 84,
in King County, Washington.

Section 3. Authorization for Administrative Action. That the Mayor
and/or designee(s) is/are further authorized to take such other action and/or
implement such other administrative procedures as may be necessary to carry
out the directives of this legislation.
Section 4. Compensation from General Fund. That the compensation
to be paid to the owners of the property to be acquired by the condemnation
action shall be paid from the General Fund of the City.
Section 5. Severability. The provisions of this ordinance are declared
to be separate and severable. The invalidity of any clause, sentence, paragraph,
subdivision, section or portion of this ordinance, or the invalidity of the application
thereof to any person or circumstance shall not affect the validity of the
remainder of this ordinance, or the validity of its application to other persons or
circumstances.
Section 6. Effective date. This Ordinance shall take effect and be in
force five days from and after its passage, approval and publication as provided
bylaw.
