HomeMy WebLinkAbout6131ORDINANCE NO. 6 1 3 1 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, AUTHORIZING THE LEVY OF REGULAR PROPERTY TAXES BY THE CITY OF AUBURN FOR COLLECTION IN 2008 WHEREAS, the City Council of the City of Auburn has met and considered its budget for the calendar year 2008; and WHEREAS, pursuant to RCW 84.55.120 the City Council held public hearings on October 1, 2007 and November 19, 2007 after proper notice was given, to consider the City of Auburn's 2008 budget and the regular property tax levy to support it; and WHEREAS, the City Council of the City of Auburn, after public hearing, and after duly considering all relevant evidence and testimony presented, has determined that the City of Auburn requires property tax revenue and any increase of new construction and improvements to property, any increase in the value of state-assessed property, annexations, and any refund levies in order to discharge the expected expenses and obligations of the City and in its best interest; and WHEREAS, the citizens of Auburn approved Proposition No. 1 in the November 2004 General Election which sets the levy limit factor for computing the maximum levy amount in 2006 - 2010 at 103%. NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS: Ordinance No. 6131 November 19, 2007 Page 1 of 4 Section 1. Regular property taxes for collection in the City of Auburn for the year 2008 are authorized in the amount of $9,685,000. Including the addition of new construction and improvements to property, any increase in the value of state assessed property, any increases resulting from annexation and any refund levies available, the regular property tax levy for 2008 collection represents a decrease from regular property taxes actually levied for collection in 2007 of Five Million Nine Hundred Sixty Two Thousand Two Hundred Fifty Seven Dollars ($5,962,257), which is a thirty nine percent (39%) decrease from the previous year. Section 2. Two Million Two Hundred Thousand Dollars ($2,200,000) of this levy to be designated to the City's SOS program as provided for in Ordinance 5864 which outlines use to be `Specifically for the Street Improvements program that includes any improvements to the local streets system consisting of preservation, restoration, and reconstruction of existing pavements, street drainage system, sidewalks, pedestrian walkways, and handicap access ramps, provision of street lights to meet the city's standard, crosswalks, channelization, parking, traffic calming, congestion improvements, and other improvements determined by the council to provide meaningful and beneficial quality of life improvement to the local community and any collector arterial that the Council determines on a case by case basis services primarily a residential character or community public school safe walking route'. In order to avoid unnecessary interfund loans caused by uneven cash flow requirements for tax-supported funds, the Finance Director is hereby authorized to allocate individual property tax receipts in a manner that eliminates interfund loans. Section 4. If any section, subsection, sentence, clause or phrase of this Ordinance is for any reason held to be invalid or unconstitutional, such invalidity or unconstitutionality shall not affect the validity or constitutionality of the remaining portions of the Ordinance, as it being hereby expressly declared that this Ordinance and each section, subsection, sentence, clause or phrase hereof would have been prepared, proposed, adopted and approved and ratified irrespective of the fact that any one or more section, subsection, sentence, clause or phrase be declared invalid or unconstitutional. Section 5. Implementation. The Mayor is hereby authorized to implement such administrative procedures as may be necessary to carry out the directives of this legislation. Section 6. Effective Date. This Ordinance shall take effect and be in force five (5) days from and after its passage, approval and publication as provided by law.
