A RESOLUTION OF THE CITY OF AUBURN, WASHINGTON, AUTHORIZING THE MAYOR AND CITY
CLERK TO ENTER INTO A LEASE AGREEMENT WITH ROBERT C. GREENE FOR CERTAIN
LEASED PREMISES`LOCATED WITHIN THE CITY OF AUBURN, WASHINGTON.
THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, AT A REGULAR
MEETING DULY ASSEMBLED HEREWITH RESOLVES:
THAT the Mayor and City Clerk are herewith authorized and directed to
enter into a Lease Agreement, on behalf of the City of Auburn, with ROBERT C.
GREENE, for the purpose of leasing certain property owned by the City of Auburn
to the said Robert C. Greene. A copy of said Lease Agreement is attached hereto
and denominated Exhibit."A", and made a part hereof as though set forth herein
in full.

LEASE AGREEMENT
__
THIS LEASE made this 17th day of July 1973, by and between the
City of Auburn, a municipal corporation of the State of Washington, hereinafter
called "Lessor" and Robert C. Greene, hereinafter called "Lessee",
WITNESSETH: That
1. CEASED PREMISES. The Lessor does hereby lease and let unto the Lessee
the fallowing described real estate located in Auburn, King County, Washington,
to-wit:
Tract "A" Cameron Village Division No. 1.
2. TERM. The term of this lease shall be from July 17, 1973, to July
16, 1975, provided, however, either party hereto may terminate this lease by giving
the other party hereto, written notice of intention to terminate not less than sixty
(60) days prior to said parties intended termination date.
3. RENT. The Lessee covenants and agrees to pay Lessor as rental for said
premises the sum of TWO HUNDRED DOLLARS ($200.00) per year, payab]e $200 on July
17, 1973, and $200 on July 17, 1974, provided however, should either party exercise
its termination provisions under the terms of paragraph 2 above, then in that event,
said rental payments shall be prorated.
4. UTILITIES. During the period of the term of this lease, the Lessee
covenants and agrees to pay all authorized and legal utility bills levied for the
use of said real property.
5. USE OF PROPERTY. During the term of this lease, the Lessee shall use
the above described real property for a beef cow and calf operation, which is storage
of hay, feed and the feeding of cows and calves. All buildings on the above des-
cribed real property are to be available for use by Lessee during the term of this
lease. The Lessee may house hay machinery in the machine shed. All materials
furnished by the Lessee for the use of the above described real property shall
remain his to remove upon the termination of this Lease.

6. RIGHT OF CITY TO TEAR DOWN BUILDINGS.
During the term of this Lease,
should the Lessor wish to tear down buildings on the above described real property,
the Lessee will be given first consideration to have the opportunity to remove said
buildings from said real property.
7. HOOD IiARMCESS AGREEMENT.
During the term of this Lease the Lessee agrees
to save and hold harmless the Lessor from any and all liability incurred by virtue
of the Lessee's utilization of the above described real property, and further Lessee
covenants to be responsible for any repairs for lighting, water lines and fencing, at
no cost to the Lessor during the term of this Lease.
8. DEFAULT-AND RE-ENTRY. Failure of the Lessee to pay the rental herein
specified as and when the same shall become due and payable, or the violation of
any of the terms and conditions of this Lease, shall constitute grounds for termi-
nation thereof by Lessor, upon giving Lessee thirty (30) days written notice. Upon
expiration or termination of this Lease as herein provided, the Lessee shall peace-
fully surrender possession of said premises, provided however, all material furnished
by Lessee not permanently attached to buildings on the above described real property
shall be removed by the Lessee, and provided further, that in the event Lessor is
required to undertake any legal action of any type whatsoever to enforce the pro-
visions of this Lease, then in such event, Lessee covenants and agrees to pay to
Lessor its reasonable attorneys fees sustained therein.
IN WITNESS WHEREOF, the parties have signed and sealed this Lease the day
and year first above written.

On this 17th day of July, 1973, before me, the undersigned, a Notary
Public in and for the State of Washington, duly commissioned and sworn, personally
appeared STANLEY P. KERSEY and ELEANOR JOHNSON, to me known to be the Mayor and
Deputy City Clerk respectively, of the City of Auburn, a municipal corporation,
and the corporation that executed the foregoing instrument, and acknowledged
the said instrument to be the free and voluntary act and deed of said corporation,
for the uses and purposes therein mentioned, and on oath stated that they are
authorized to execute the said instrument and that the seal affixed is the cor-
porate seal of said corporation; and ROBERT C. GREENE, to me known to be the
individual described in and who executed the foregoing instrument and acknowledged
that he signed and sealed the same as his free and voluntary act and deed, for
the uses and purposes therein mentioned.
