A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
AUBURN, WASHINGTON, RATIFYING AN EMERGENCY
DECLARATION WITH RESPECT TO THE REPAIR OF A WATER
MAIN AT 3RD AND `B' STREETS NE, IN AUBURN, WASHINGTON
WHEREAS, on or about December 30, 2006, a fire hydrant located at 3rd and `B'
Streets NE, within the City of Auburn, was hit by an errant driver; and
WHEREAS, the impact to the fire hydrant broke the water main below ground;
and
WHEREAS, the excessive force of the water from the water main and broken fire
hydrant pipe washed out the subgrade beneath the sidewalk and roadway; and
WHEREAS, the depth of the washed out area is not known; and
WHEREAS, the washed out area contains a utility gas main and power conduit;

WHEREAS, a delay in repairing the water main would cause further damage to
the sidewalk and roadway, and possible further exposure of the gas main and power
conduit; potentially increasing the cost to the City for repair; and
WHEREAS, the exposed utilities and damaged sidewalk and roadway pose a
danger to pedestrians and drivers; and
WHEREAS, the City has a responsibility to provide safe roadways and sidewalks
for its citizens; and
WHEREAS, pursuant to the authority of Section 3.10.050 of the Auburn City
Code, the Mayor determined and declared that an emergency existed so as to justify
the emergency contracting procedures without formal bidding.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, HEREBY RESOLVES as follows:
Section 1. That the City Council ratifies the Mayor's determination and
declaration that an emergency exists in this case, and finds the need for the City to
enter into a contract for the repair of a water main, sidewalk, and roadway at 3~d and 'B'
Streets NE, without going through typical bidding procedures in an emergency that
relieves the City of the requirement to engage in a more lengthy competitive bidding
process for this equipment.
Section 2. That the Mayor or his designee is authorized to negotiate and enter
into a contract with VLS Construction, Inc., to address the needed repairs at 3~d and `B'
Streets NE.
Section 3. This resolution shall be in full force and effect upon passage and
signatures hereon.
