The entire area of the building on.owner's property is excluded from the TCE, and the City guar6ntess that the building will not be disturbed in any way thrieughout the construction period. • No utility poles or traffic signal poles will be located on owner's remainder property. • The City in a future project will provide a left turn facility on Auburn Way North to Allow northbound traffic to turn left westbound onto 4th street NE. such project is a priority roadway project for the City which is subject to funding expected in the next 2 years. • The City will provide owners 30 days advance written notice of the date on which its Construction will commence on owner's property. The City agree$ to use its best efforts to finish the use of the temporary construction easement, and the construction of its project as relates to owner's property, as soon as t,~7 reasonably possible. The City agrees that in construction of its project it will make all reasonable efforts to mitigate the V4 impact of its project qn the business conducted on owner's property and to minimize the loss of business profits caused by Cn its project to the business conducted on owner's property. * The building and lot shall not be rendered non conforming by this condemnation. * Owners waive all the poovisions of RCW 8.26 including without limitation such as relate to appraisal, negotiation, offers, fair market value, notic6 to move, etc.
