Pitts, et ux, et al are Grantors and City of Auburn is Grantee dated April 18, 1984 The parties hereto covenant and agree as follows: --That the Grantee herein agrees to reimburse Grantor on a prorata basis for all costs associated with the subdivision of the plat known as RPM-Auburn, including, but not limited to, engineering, surveying and the costs associated with utilities and road improvement and installation -Such prorata basis shall be determined on a square footage basis with the Grantee herein having a square footage in Lot 1, RPM-Auburn of 95,419.32 square feet as to a total square footage in the subdivision of 213,981.06 or Grantee is in possession of 44.59 percent of the total square footage --Grantor covenants that the maximum total cost will not exceed the same percentage of the total improvement bond with the City of Auburn for development of the plat or $103,448.08. --Grantor herein shall deliver to Grantee upon completion of the road and any other plat improvements, a statement showing a breakdown of the cost of all items as agreed. Grantee shall pay such final cost accounting, not to exceed the amount as shown above, within ten (10) days of receipt of such O final accounting.
