KNOW ALL MEN BY THESE PRESENTS that for and in consideration of
the sum of ten dollars ($10.00) and other good and sufficient consideration, receipt whereof is
hereby acknowledged, the undersigned CADDIS INDUSTRIAL, LLC, a Washington
limited liability company ("Grantor"), does by these presents hereby convey, setover,
assign, transfer and warrant to the CITY OF AUBURN, A MUNICIPAL
CORPORATION, its successors and assigns ("Grantee"), in King County, Washington, 314
LF of a 12" DI CL. 52 waterline, 364 LF-8" waterline, 312 LF of 8" PVC sanitary sewer and
all appurtenances or any other associated public facility as shown on the public facility
extension plans referred to as FAC 0030-98, for The Caddis Building development, situated
within the following described real property:

and the said Grantor hereby warrants that it is the sole owner of all of the property above
conveyed; that it has full power to convey the same and that it will defend the title of said
Grantee against any and all persons lawfully making claim thereto, and indemnify the City of
Auburn for any costs, including attorneys' foes in defending title. .
