the CITY OF AUBURN, a municipal corporation of King County, State or Washington,
hereinafter termed "Grantee" and Safewav Stores, Incorporated, a Maryland
corporation "Grantor".

O The Grantor does hereby grant unto the Grantee and its authorized agents a

street improvement on adjacent- property; said temporary easement

Beginning at the southeast corner of said lot 6; thence north 0039'45"
west, along the east margin of said lot 6, 19.67 feet to a point of
curvature of a curve having a radius of 20.00 feet, the center of which
bears south 89020'15" west; thence southwesterly along said curve, an arc
distance of 31.08 feet to a point on the south line of said lot 6; thence
north 88022'35" east, 19.67 feet along said south line to the point of

Said temporary easement is herein granted on the condition that
1. If the surface of the easement and/or surface of Grantor's adjacent real property
and/or any improvements thereon shall be disturbed by installation, operation, maintenance,
repair or replacement, said surface and/or improvements shall be promptly restored by Gran-
tee to their condition just prior to such disturbance.
2. That Grantee indemnifies Grantor against and save Grantor harmless from all demands,
claims, causes of action or judgments, and all reasonable expenses incurred in investigating
the same, for injury to person, loss of life or damage to property occurring on the ease-
ment area and arising out of Grantee's use and occupancy of said area.
IN WITNESS WHEREOF the parties hereto have executed this Construction Easement as of
the day and year first above written.
