For and in consideration of One Dollar ($1.00) and other valuable consideration in hand paid, SEQUENCE
FARMS SOUTH, L.L.C., a Washington limited liability company ("Grantor" herein), it's successors and assigns
hereby donates and grants to the CITY OF AUBURN, a Washington municipal corporation ("Grantee" herein), it's
successors and assigns for the purposes hereinafter set forth, a nonexclusive perpetual easement under the surface of
the following described real property ("Easement Area" herein) in KING County, Washington:
THE EAST 10.00 FEET OF PARCELS I AND 2, CITY OF AUBURN LOT LINE ADJUSTMENT
NO. LLA-03-0009, RECORDED UNDER KING COUNTY RECORDING NUMBER
20030805000224;
EXCEPT THE SOUTH 30.00 FEET OF SAID PARCEL 2;
IN KING COUNTY, WASHINGTON.
1. Purpose. Grantee shall have the right to operate, maintain, repair, replace, improve, remove, enlarge,
and use the Easement Area for one underground stormwater utility piping system, together with the right of access
over, under and across the surface of said Easement Area to enable Grantee to exercise its rights hereunder. As
used herein, the term "System" shall include all appurtenances and facilities as are necessary, in the judgment of
Grantee, for the operation and maintenance of said System.
2. Grantor's Use of Easement Area. Grantor agrees not to erect any structures on said Easement Area,
that would interfere with the exercise of Grantee's rights herein. No excavation shall be made within three (3) feet
of said System without the prior written consent of the City,which shall not be unreasonably withheld, and the
surface level of the ground within the Easement Area shall be maintained at the elevation as currently existing.
Grantor additionally grants to the City, the use of such additional area immediately adjacent to said Easement Area
as shall be required for the construction, reconstruction, maintenance and operation of said System. The use of such
additional area shall be held to a reasonable minimum and in the case of any damage or disruption of the adjacent
premises, the City shall return the property to a condition as reasonably comparable to its condition as it existed
immediately before entry and/or work was made thereon by the City or its agents. In addition to the other
restrictions herein, Grantor shall not convey to a third party any easement or other right of usage in the property that
would impair or limit the City's use of the Easement Area. Said document(s) were filed for
