E A S E M E N T
THIS AGREEMENT made this 15 day of December , 1987 ,
by and between the City of Auburn, a municipal corporation of King
County, Washington, hereinafter termed "Grantee" and
Gilbert and Caryn Wood and
Dave and Mary McKim , xhtWxWifaK
hereinafter termed "Grantor".
- WITNESSETH: -
That the said Grantor for valuable consideration does by
these presents
Sgrant unto the Grantee a perpetual right-of-way or
easement for eWmaim enance with the necessary appurtenances
through, over and across the following described property-situated
in King County, Washington.
That portion of the East 682.4 feet of Tract I, lying West of Valley Freeway
SR 167.and lying. Northerly of 37th Street Northwest as relocated, under King
County Recording No. 6575257, Town of Christopher, according to the plat
recorded in Volume 7 of Plats, page 30, in King County, Washington;
TOGETHER WITH'vacated Rose Street adjoining on the North.

That said Grantee shall have the right without prior
institution of any suit or proceeding at law, at times as may
be necessary, to enter upon said property for the purpose of
constructing, repairing, altering, or reconstructing said facility,
O or making any connections therewith, without incurring any
legal obligation or liability therefore; provided that such
constructing, repairing, altering or reconstructing of said
facility shall be accomplished in such a manner that the private
improvements, existing in this right-of-way shall not be disturbed
or destroyed, or in the event that they are disturbed or destroyed,
they will be replaced in as good a condition as they were immedi-
ately before the property was entered upon by the Grantee.
The Grantor shall retain the right to use the surface
of said easement, so long as said use does not interfere with
the installation and maintenance of the facility and so long
as no permanent buildings or structures are erected on said
easement. Large trees which may interfere with future maintenance
or repair of the line shall not be planted within the easement.
This easement shall be a covenant running with the land and
shall be binding on the successors, heirs, and assigns of both
parties hereto.

CONSENT
WHEREAS, The City of Auburn, a municipal corporation of the State of
Washington, hereinafter called "Municipality," has easement rights on certain
property for a sewer line under the terms of an easement recorded as Auditor's
File No. 8012230775, records of King County; and
WHEREAS, Pacific Northwest Bell Telephone Company, hereinafter called
"Pacific," desires to install certain underground telephone facilities within
-the same easement area shown on Sketch attached hereto and by this reference
made a part hereof;
A.
NOW, THEREFORE, the Municipality consents to said installations subject to
.the following terms and conditions:
1. In the event the above referenced property is disturbed by the
installation, maintenance, removal, repair, or replacements of the underground
telephone facilities specified herein, Pacific shall restore the surface
of the above referenced property as nearly as possible to the condition in
which it existed as the commencement of said installation, maintenance,
removal, repair or, replacement.
2. Pacific shall protect and save harmless the Municipality from any
and all claims, demands, loss, damage, expense and liability of every kind
and description, including personal injury and for any damage.-to or loss or
destruction of property whatsoever suffered by the Municipality, or by any
persons, firms, or corporations arising from or related to the installation,
use, and/or maintenance of Pacific's telephone facilities.
