For and in consideration of TEN AND N01100 DOLLARS ($10.00) and other good
and valuable consideration in hand paid, receipt of which is hereby
acknowledged, and for benefits to be derived by the Grantor herein,
Grantor, T. J. TORGERSON AND BETTY M. TORGERSON, hereby conveys and
warrants to the City of Auburn, a Municipal Corporation of the State of
Washington, its successors and assigns, a perpetual nonexclusive easement
under, over, through and across the following described land for the
purpose of laying, maintaining, and installing PUBLIC UTILITIES, said land
being described as follows:
THE SOUTH 10.00 FEET OF THE FOLLOWING DESCRIBED PARCEL OF LAND:
BEGINNING AT THE SOUTHEAST CORNER OF THE WILLIAM A. COX DONATION CLAIM
NO. 381; SITUATE IN SECTION 31, TOWNSHIP 22 NORTH, RANGE 5 EAST, W.M.;
THENCE,-NORTH ALONG THE EAST BOUNDARY OF SAID DONATION CLAIM, 297.88
FEET; THENCE WEST ON A LINE PARALLEL WITH THE SOUTH BOUNDARY OF SAID
DONATION CLAIM, 398.00 FEET; THENCE SOUTH ON A LINE PARALLEL WITH THE
EAST LINE OF SAID DONATION CLAIM, 150.00 FEET; THENCE WEST ON A LINE
PARALLEL WITH THE SOUTH BOUNDARY OF SAID DONATION CLAIM, 318.00 FEET
MORE.OF LESS TO THE EAST MARGIN OF STATE ROAD NO. 5; THENCE SOUTHERLY
c ALONG SAID EAST MARGIN OF STATE ROAD NO. 5 TO THE SOUTH BOUNDARY OF
SAID DONATION CLAIM; THENCE EASTERLY TO THE POINT OF BEGINNING. LESS
THE WEST 10.00 FEET THEREOF DEEDED TO KING COUNTY FOR ROAD BY DEED
UNDER RECORDING NUMBER 7556211; LESS THE SOUTH 30.00 FEET AND THE EAST
30.00 FEET FOR ROADS DEEDED TO THE CITY OF AUBURN BY INSTRUMENT
C RECORDED UNDER RECORDING NUMBER 7107090468; LESS THE WEST 368.00 FEET
OF THE EAST 398.00 FEET.
r Said Grantee shall have the absolute right, at times as may be necessary,
to enter upon said easement for the purpose of maintenance, construction,
repair or reconstruction of the above improvements without incurring any
legal obligation of liability therefor.
This easement shall be a covenant running with the land and shall be
binding on the successors, heirs and assigns of all parties hereto.
