Tacoma, Department of Public Utilities, Water Division
Easement No.'s 670 & 563)
We, the undersigned, City of Auburn, a municipal Corporation, organized and
existing under the laws of the State of Washington, record owner of the premises
hereinafter described, hereinafter referred to as "Grantor," for a valuable
consideration from the City of Tacoma, Department of Public Utilities, Water Division
(d.b.a Tacoma Water) hereinafter referred to as "Tacoma Water," do hereby grant
unto said Tacoma Water, its successors and assigns, the right and privilege to
construct, reconstruct, install, operate, inspect and maintain a water transmission
pipeline, or pipelines, and appurtenant equipment, including telemetering and
control devices in, under, over, along and across the following real property situate
and being in the County of King and State of Washington, described as follows,
to-wit:
See Exhibits "A", "B" attached hereto and by this reference incorporated herein.
This document supersedes and replaces that Easement recorded under King
County AFN 730918 and supersedes and replaces that portion of the Easement
recorded under King County AFN 7301120133 lying East of the Easterly boundary
of Parcel C of Auburn short Plat 20-80 recorded under King County AFN
7101079005. (City of Tacoma, Department of Public Utilities, Water Division
Easement Nos. 670 and 563.)
Together with the right to remove all trees located upon the land above described
and with the privilege also to enter upon said land from time to time with personnel
and equipment necessary to accomplish all of said purposes.
Together with the right to trim and keep trimmed all vegetation located upon the
tract of land above described.
It is agreed that the Grantor and its successors shall not construct or permit the
construction or installation of any permanent buildings or structures within the
easement area, without the prior written permission of the Grantee.
The Grantor shall at all times provide access to Tacoma Water staff and their
contractors, to change, repair, renew, or remove said equipment or facilities. The
Grantor herein further grants to Tacoma Water, its contractors and/or agents, the
right to hereafter temporarily enter upon the Grantor's remaining lands where
necessary to construct or maintain said facilities.
The City of Tacoma shall submit drawings prior to construction of any above ground
installations for review and approval by the Grantor.

The City of Tacoma shall at its cost and to the extent reasonably practical, replace
or relocate all facilities which it may believe necessary to remove, relocate or disturb
in the performance of said work and shall return the land to its original condition
within a reasonable time thereafter.
The City of Tacoma will be responsible for restoring the fairways and existing
practice green to a condition of as good as, or better than, existing at the time
immediately prior to construction. In addition, it shall be the obligation of the City to
restore all facilities, sewage systems, underground water systems, which might be
disrupted during construction of said pipeline or pipelines.
The City of Tacoma shall reimburse the City of Auburn, or its Lessee, if the Golf
Course across which the above-described easement runs, is required, due solely to
the City's construction, to be interrupted and be closed during said construction.
The City of Tacoma will reimburse the City of Auburn only for the loss of revenue
during the period of closure necessitated by the construction by the City of
Tacoma's contractor. The loss of revenue would be based upon income received
during a comparable period of the previous year that the Golf Course was open and
operating.

LEGAL DESCRIPTION
A strip of land located in Government Lots 9 and 10 and in the North 742.50 feet of the South
1649.34 feet of the Harvey H. Jones Donation Claim Number 39, in Section 6, Township 21
North, Range 5 East, WM. King County Washington, being 100 feet in width, lying 50 feet on
each side of the following described centerline:
Commencing at the 1/4 corner common to Sections 5 and 6 Township 21 North, Range 5 East,
WM.; thence along the line common to said Sections 5 and 6, North 02° 56'40" East, 156.26 feet
to the Point of Beginning. Thence for following five courses along said centerline, South 81° 39'
15" West, 112.04 feet; thence South 52° 21'36" West, 570.44 feet more or less, to a point 50.00
feet northerly, measured at a right angles, from the south line of the North 742.50 feet of the
South 1649.34 feet of the Harvey H. Jones Donation Claim Number 39; thence along a line
parallel to and 50.00 feet northerly from said south line, North 89° 03'06" West, 1502.05 feet;
thence North 43° 59'47" West, 144.92 feet more or less, to a point 30.00 feet northerly, when
measured at right angles, from the south line of the 262.50 foot wide Bonneville Power
Administration Tacoma-Covington No.3 right-of-way through said Section 6; thence along a line
parallel to and 30.00 feet northerly from said south line, North 88° 59'38" West, 46.54 feet more
or less, to a point on the easterly boundary of Parcel C of Auburn Short Plat 20-80 recorded at
auditors file number 7101079005 records of King County and the terminus of this description.
Except therefrom King County Green River Road.
Together with a strip of land located in Government Lot 6 and the North 1/2 Southwest 1/4
Section 5, Township 21 North, Range 5 East, WM. King County Washington, being 100 feet in
width, lying 50.00 feet on each side of the following described centerline.
Commencing at the 1/4 corner common to Sections 5 and 6 Township 21 North Range 5 East
WM.; thence along the line common to said Sections 5 and 6, North 02° 56'40" East, 156.26 feet
to the Point of Beginning; thence for the following six courses along said centerline, North 81 °
39' 15" East, 358.40 feet; thence South 41° 37'08" East, 465.35 feet; thence South 79° 49' 38"
East, 387.58 feet; thence South 89° 19'20" East, 668.31 feet; thence North 44° 03' 52" East,
