The undersigned as authonzed agent for Rainier Properties hereinafter referred to as "Owner''
of the progeny described below and commonly known as 1 (One) 16th Street Northeast, Auburn,
WA, hereby selmowlodges the taros send conditions of an easement for sewer and spptutmances
in favor of the City of Auburn, King County recording co. 7109100534, said real property being
described as follows:

Said Owner ktavirig constructed a sign wNch is located an z portion of the sewer and
appu tamices easement. That the placement of said fitp compromises the sewer and
appurtenances casement w rccordod as number 7109100524 rights granted to the City of Auburn
by encroaching upon said easement.
In considti ation of ft City of Auburn's final approval for the sip construction on said property
easement, the Owner hereby agrees to be nnponsiblc for and assume any and all liability for
dwages of any kind caused to siM or for tuty damages caused by the sign to the sewer- or waft
lines located within the said above-referenced sewer easement. Also the Owner hereby agrees to
be responsible for and assumes any and all liability lot all additional costs that the Girt' incurs as
a resWt of the unique sewer sad water constnution and repair rnethodls required to be employed
by the City within said easement witlsiti 30 feet on either side of said sign within the sewer
easement.
Further the Owl= hereby 18mcs to be rospomibic for Ray cost incurred to mafntain or repair the
sewer and wow pipelines and appurtenances wid= a 10-foot circle centered on base oftbe sigh
as presently erected, even to the extent of relocating said sign if such is dewrmiaed by the City to

be necessary for its maintenance and repair of said sewer and water pipelines or the
appurtenances.
This Agreement shall be a covenant running with the above described real propcrty and burden
said real estate, and shall be binding on the successors, heirs and assigns of all parties hereto.
