Bellevue, WA 98004 83,13,2 CITY EASEMENT THIS EASEMENT supercedes and replaces the sanitary sewer easement shown on the recorded plat and as described in the unrecorded easement dated April 27, 1992 attached hereto as Attachment A. cn In N O M (D Cl) For and in consideration of the sum of one dollar ($1.00) and other good and valuable consideration, receipt of which is hereby acknowledged, and for benefits to be derived by the Grantor herein, Grantor, CONNER DEVELOPMENT COMPANY, as owner of lots 11 and 12 of the recorded plat of Rainier Shadows as platted in Volume 156, pages 40 through 44, book of plats, records of King County, Washington, hereby conveys and warrants to the City of Auburn, Grantee herein, a Municipal Corporation of the State of Washington, its successors and assigns, a perpetual nonexclusive easement under, over, through and across the following described real property for the purpose of laying, maintaining, and installing SANITARY SEWER MAINS, MANHOLES APPURTENANCES THEREOF, said real property described as follows: A 20.00 foot Sanitary Sewer Easement being 8.0 feet Westerly and 12.0 feet Easterly of the following described line wherever described easement crosses lots 11 and 12 of the plat of Rainier Shadows recorded in Volume 156 at page 40-44 book of plats, records of King County, Washington. _ gK0 0 0 N 1 N r N O O O S 0 ~19 0 a 0 w WASl~,N Commencing at the northwest corner of aforementioned lot 11; 0 coo Thence S 89 58'39" W, 7.5 feet along the north boundary of said plat to t ey X. TV point of beginning of said line. -0 0. Thence S 02 43' 15" E, 137.01 feet to a point of intersection with the north 'P- '228353 right-of-way line of S.E. 306th Court. G!SV . Except where any portion of the aforementioned strip of land is encroache by the foundation existing on Lot 12 as it existed on the date of this easem ExP:1REE 7~E; y December 1992, and as is approximately shown on attached Exhibit A. Said Grantee shall have the absolute right, at times as may be necessary, for immediate entry upon said Easement for the purpose of maintenance, construction, repair or reconstruction of the above improvements without incurring any legal obligation or liability therefore. Said Grantee shall have the absolute right to place any type of driving surface within said Easement deemed necessary by the Grantee. Said Grantor shall not in any way block, restrict or impede access and egress to or from said Easement, and/or in any way block, restrict or impede full use of the real property within the above-described Easement by said Grantee for the above-described purposes. Said Grantor may fence across said Easement and/or along the boundaries of said Easement provided that a gate is constructed in said fence. If said gate is to be locked, keys shall be provided to the Grantee. This easement shall be a covenant running with the above-described real property and shall be binding on the successors, heirs and assigns of all parties hereto. IN WITNESS WHEREOF, said corporation has caused this instrument to be executed by its property officers and its co orate seal to be hereunto affixed this /D day of Dnz 1992. This instrument becomes effective and replaces the instrument in Exhibit B at such time as it is signed and accepted by the signature of the City of Auburn below.
