THIS AGREEMENT, entered into this date hereinafter set forth by and between
Mrs. Josephine Ribary hereinafter referred to as "Owner" and the City of Auburn
hereinafter referred to as "City".
C7 WHEREAS, the City has requested an easement for roadway, slope and storm

drainage purposes across the easterly five (5') feet of the following described

East W.M. described as follows:
The North 153.75 ft of the South 307.50 ft of the NE 1/4
of SE 1/4 said Section 11, Less Street.
AND
The North 125 ft of the South 432.5 ft of the NE 1/4 of
SE 1/4 said Section 11, except the North 15 ft of.portion
West of East 342 ft thof and Less Street.
WHEREAS, Owner agrees to grant to City the five (5') foot easement for roadway,
slope and storm drainage purposes as described above subject to the following
considerations:
1. Pave with asphalt concrete paving the two (2) existing driveways serving
the property legally described above. Said paving shall extend westerly two (2)
car lengths (approximately 40') from the traveled portion of the roadway together
with paving the shoulder area lying between the two driveways.
2. Relocate the existing board fence lying between stations 2+40+ and 376.
Said fence to be relocated along the west line of the aforesaid easement. Fence
to be reinstalled in as good or better condition as exists.
3. Install the new water service line as close as possible to existing service
line crossing and connect to existing services.
4. Owner shall be allowed to connect buildings located on aforesaid legally
described property to the existing sanitary sewer line located at the northeast
corner of their property. The frontage charge or chargein lieu of assessment for
sewer connection shall be waived until a Local Improvement District is created then
Owner agrees to pay his proportionate share of cost of sanitary sewer when extended

NOW, THEREFORE, in consideration of the mutual benefits to be derived,
"Owner" agrees to grant the aforesaid roadway, slope and storm drainage easement
and "City" agrees to accept the conditions as outlined above.
An executed copy of this easement/agreement shall be recorded among the land
records of the King County Auditor.
