That portion of the Southwest Quarter of Section 12, Township 21 North, Range 4 East, W.M. included within the limits of a strip CL of land 20 feet in width the centerline of which is described as fQ!- L~j lows: Beginning at a point on the South line of the said Southwest Quarter which is South 87°52'01" East 897.15 feet from the Southwest corner thereof; thence North 5016'22" East 464.04 feet; thence North 0028'50" East 451.98 feet; thence North 0014'19" West 411.53 feet; thence North 5013'58" West 723.01 feet'; thence North 8022'07" West 460 feet more or less to the intersection of the Southerly margin of the 15th Street Northwest Extension as delineated on that certain Washington State Highway Commission right-of-way drawing SR 167 MP 13.66 to MP 17.42, Auburn: 17th St. SW to S. 285th St., sheet 7 of 30 sheets, bearing date of approval June 12, 1969 and revised September 25, 1969 and the terminus of said centerline description; also That portion of the North 25 feet of the Southwest Quarter of the Southwest Quarter of said Section 12, lying between the above described centerline and the Westerly margin of said SR 167; also That portion of the South 25 feet of the Northwest Quarter of the Southwest Quarter of said Section 12, lying between the above described centerline and the Westerly margin of said SR 167; also That portion of the South 10 feet of the Southwest Quarter of said Section 12, lying Westerly of the Westerly margin of said SR 167. Recording of this easement cancels and supersedes easement given in favor of the City of Auburn, a municipal corporation in the State of Washington, under AuditorsF'ee No. 7906221156 and recorded on June 22, 1979. Grantor herein reserves the right to cross this easement.for the purpose of relocating Mill Creek within the north'250 feet thereof, said creek bed to maintain the same level as culvert located west of SR 167 at 15th Street N.W. Said temporary construction easement shall remain in force during construction and until such time as the sewers and appurtenances have been accepted for maintenance and operation by the City of Auburn. i Gertrude A. Jones Easement No. 79-12-3RR -2- f' r That said Grantee shall have the right without prior institution of any suit or proceeding at law, at times as may be necessary, to enter upon said property for the purpose of constructing, repairing, altering, or reconstructing said Sewer Main, or making any connections therewith, without incurring any legal obligation or liability therefor; provided that such con- structing, repairing, altering or reconstructing of said Sewer Main shall be accomplished in such a manner that the private improvements existing in this right-of-way shall not be disturbed or destroyed, or in the event they are disturbed or destroyed, they will be replaced in as good a condition as they were immedi- .qr ately before the property was entered upon by the Grantee. +D The Grantor shall retain the right to use the surface of Q said easement, so long as said use does not interfere with the ON's installation and maintenance of the Sewer Main, and so long as C:) no permanent buildings or structures are erected on said easement.
