HomeMy WebLinkAbout6013532 SEWER EASEMENT 0221664773 ' 251 EASEMENT U THIS AGREEMENT made this 91G,- day of February 196, by and between the CITY OF AUBURN, a municipal corporation of King County, Wash- ington, hereinafter termed "Grantee", and MJ►atcrk~I - Garrison and ..Charlotte L. Garrison his wife, hereinafter termed "Grantor". WITNESSETH: That the said Grantor for valuable consideration does by these presents grant unto the Grantee a perpetual right-of-way or easement for sewer mains with the necessary appurtenances through, over and across the following described property situated in King County, Washington, more particularly described as follows: The East 15 feet of the Northeast 1/4 of the Southwest 1/4 of Section 12, Township 21 North, Range 4 East W.M., EXCEPT Railroad right-of-way, and commonly known as 1425 "H" Street North, Auburn, Washington. The granting of this easement is conditioned upon the completion of the proposed sewer and the placing of the same in operation on or before two (2) years from date hereof, otherwise this easement shall be null and void, and all right thereto in the grantee and its successors and assignees shall cease. That said Grantee shall have the right without prior institution of any suit or proceeding at law, at times as may be necessary, to enter upon said property for the purpose of constructing, repairing, altering, or reconstructing said Sewer Main, or making any connections therewith, without incurring any legal obligation or liability therefor; provided that such constructing, repairing, altering, or reconstructing of said sewer main shall be accomplished in such a manner that the private improvements existing in this right-of-way shall not be disturbed or destroyed, or in the event they are disturbed or destroyed, they will be replaced in as good a condition as they were immediately before the property was entered upon by the Grantee. The Grantor shall retain the right to use the surface of said easement, so long as said use does not interfere with the installation and maintenance of the sewer main and so long as no permanent buildings or structures are erected on said easement. This easement shall be a covenant running with the land and shall be binding on the successors, heirs, and assigns of both parties hereto.
