C] QD N CV t7 Go BY THE DIVfrION OF REGQ1~DS I i.I S For ,06flq;`Jgppsider.ation of mutual benefits, Pay'n Save Corporation, a Washington corporation, hereinafter referred to as Grantor, hereby grants a perpetual easement to Pacific Northwest Sell Telephone Company, a Washington corporation, its successors and assigns, hereinafter referred to as Grantee, with the right, privilege and authority to place, construct, maintain, inspect, reconstruct, repair, remove and keep obstacles clear from Grantee's underground communication lines and other appurtenances as the Grantee may from time to time require over, across, upon and under the hereinafter-described property situated in King County, State of Washington, and is described as follows: Lot 1 Auburn SP 8-79 as recorded under Auditor's File No. 7904190888, Records of King County, - Located in Section 12, Township 21 North, Range 4 East, W.M. Lot 1, Auburn SP 4-77 as recorded under Auditor's File No. 7703250502, Records of King County. Located in Section 12, Township 21 North, Range 4 East, W.M. Said easement being the Easterly Ten (10) feet of the above described properties. Grantee shall at all times have the right of full and free ingress to and egress from said properly described above, with the understanding that Grantee shall be responsible for all damage caused to Grantor arising form Grantee's exercise of the rights and privileges herein granted. Grantee acknowledges that the easement area lies within an easement granted the City of Auburn ("Municipality") under that certain Amended Quit Claim Deed, recorded under Auditor's File No. 8107230678, Records of King County. In the event the easement property is disturbed by the installation, maintenance, removal, repair or replacement of the underground telephone facilities specified herein, Grantee, its successors and assigns shall restore said easement property as nearly as possible to the condition in which it existed as the commencement of said installation, maintenance, removal, repair or replacement. Grantee, its successors and assigns shall protect and save Municipality and Grantor from any and all claims, demands, loss, damage, expense and liability of every kind and description, including personal injury or for any damage to or loss or destruction of property whatsoever suffered by the Municipality, Grantor or by any persons, firms, or corporation arising from or related to the installation, use, and/or maintenance of Grantee's telephone facilities. The rights, conditions an.d provisions of this easement shall inure to the benefit of and be binding upon the heirs, executors, administrators, successors and assigns of the respective parties hereto. Should Grantee, its successors and assigns, cease to use said easement in, over and across said parcel or tract of land for sanitary sewer purposes with the permanent intent to abandon and relinquish the same, then said easement shall revert to Grantor, its heirs and assigns. ri E ~ IN WITNESS WHEREOF, the and rsigned has executed this instrument this :j1~ day of .s , 1985.
