KASPER and BELLA KASPER, his wife, hereinafter termed "GRANTOR". WITNESSETH: ~N That thess&!& GRANTOR for valuable consideration does by these presents grant unt,.,) the GRANTEE a SLOPE EASEMENT with the right. to make•all necessary slidpes''upon the ',abutt g =pzoperty"for cuts ' and fills as may be required in the construction of roadway improvements on HI-CREST DRIVE and KNICKERBOCKER DRIVE. The-slope easement is described.as follows: That portion of Lot 4 Block , . ,~4 _kerbocker He.~ghts^Additon, ';as recorded in Volume;45 of Plats,, Page 93, records of 1 King County, Washington, LESS City of Auburn street right-of-way described-as,follows: Be!7in at a point at the intersection of the Westerly margin of Hi-Crest Drive and'the Southerly margin of Knickerbocker Drive, said point being the Northeasterly corner..of said Lot. 4; thence Westerly along the Northerly boundary of said Lot4, 50.00 'feet; thence Southeasterly 52.00 feet, more or less, to a point on,!the Weste'rly`margin of Hi-Crest Drive, said point being 10.00 feet, measured along said Westerly margin of Hi-Crest Drive, Southerly of the point of beginning; thence Northerly 10.00 feet to the point of beginning. THIS EASEMENT is granted on the following TERMS and CONDITIONS: 1. GRANTEE agrees.to save and hold GRANTOR harmless from all loss or dam- ages which may be due to the exercise'by GRANTEE of the right herein granted and -from all~clazms-for-such- darnage. by'-whomsoever'-made- and to indemnify GRANTOR for - all such loss, damage, and claims. 2. GRANTEE agrees to.seed all new slopes with suitable grasses to elim- inate erosion. 3. GRANTEE agrees to try and save large evergreen tree adjacent to the NE .corner ofaforesaid Lot 4. In the event said tree is removed because of said con- struction, GRANTEE agrees to plant a similar type of evergreen tree approximately 6 feet in height. THAT SAID GRANTEE shal•1 have the right without prior institution of any suit or proceeding at law, at times as may be necessary, to enter upon said ease- ment for -the purpose of placement of roadway slopes, provided that such construc- tion shall be accomplished in such a manner that private improvements shall not be disturbed or destroyed, or in.the event they are disturbed or destroyed, they will be replaced in as good a condition as they were immediately before the prop- erty was entered upon by the GRANTEE. THIS EASEMENT shall be automatically extinguished in the event GRANTOR, its heirs, successors, and assigns,'bring the lands herein burdened by the ease- men t'totheF-grade--of GRANTEES-nearest-.pavemenf-' THIS EASEMENT shall be covenant running with the land and shall be binding on the successors, heirs, and assigns of both parties hereto.
