A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, AUTHORIZING THE MAYOR TO EXECUTE A PUBLIC STORM
DRAINAGE FACILITIES EASEMENT BETWEEN THE CITY OF AUBURN AND
THE CITY OF AUBURN STORM DRAINAGE UTILITY ENTERPRISE FUND.
WHEREAS, the City of Auburn Storm Drainage Utility
requires an easement across the City of Auburn's Cemetery
property for the construction of a storm drainage and debris
control facility.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, IN A REGULAR MEETING DULY ASSEMBLED, HEREWITH
RESOLVES AS FOLLOWS:
Section 1. The Mayor of the City of Auburn is herewith
authorized to execute a Public Storm Drainage Facility
Easement between the City of Auburn and the City of Auburn
Storm Drainage Utility Enterprise Fund. A copy of said
Easement and map are attached hereto and denominated as
Exhibits "A" and "B" respectively and incorporated herein.
Section __2. The Mayor is hereby authorized to implement
such administrative procedures as may be necessary to carry
out the directives of this legislation.

consideration, receipt of which is hereby acknowledged, and for benefits to be derived by the
Grantor herein, Grantor, City of Auburn, a municipal corporation, hereby conveys and warrants
to the City of Auburn, Storm Drainage Utility Enterprise Fund, Grantee herein, a municipal
corporation of King County, Washington, its successors and assigns, a perpetual Nonexclusive
Easement under, over, through and across the following described real property for the purpose
of laying, maintaining, and installing public storm drainage facilities AND APPURTENANCES
THEREOF, said real property being described as follows:
SEE EXHIBIT "A", ATTACHED HERETO AND BY-THIS REFERENCE MADE A
PART HEREOF.
Said Grantee shall have the absolute right, at times as may be necessary, for immediate entry
upon said Easement for the purpose of maintenance, inspection, construction, repair or
reconstruction of the above improvements without incurring any legal obligation or liability
therefore.
Said Grantee shall have the absolute right to place any type of driving surface within said
Easement deemed necessary by the Grantee.
Said Grantor shall not in any way block, restrict or impede access and egress to or from said
Easement, and/or in any way block, restrict or impede full use of the real property within the
above-described Easement by said Grantee for the above-described purposes. Said Grantor may
fence across said Easement and/or along the boundaries of said Easement provided that a gate is

constructed in said fence. Said gate shall be of sufficient length and location to allow the Grantee
full use of, and access and egress to and from the real property within the above-described

said real estate, and shall be binding on the successors, heirs and assigns of all parties hereto.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AN
4 EASEMENT TO PUGET POWER FOR A SEVENTY-FIVE-FOOT WIDE STRIP OF
LAND LOCATED IN GSA PARK.ON CITY OF AUBURN PROPERTY WHICH IS
5 LOCATED WEST OF "C" STREET, SOUTHWEST, AND NORTH OF 15TH
STREET, SOUTHWEST.

7 WHEREAS, the City of Auburn Parks Department has
8 constructed a new maintenance building located in GSA Park on
9 City of Auburn property located west of "C" Street, Southwest,
and north of 15th Street, Southwest; and
10
11 WHEREAS, the Puget Power company requires a seventy-five
12 foot wide easement in order to supply power to the maintenance
13 building; and
14 WHEREAS, the City of Auburn Parks Department recommends
15 the granting of the easement to Puget Power;
16 NOW, THEREFORE, THE CITY COUNCIL OF. THE CITY OF AUBURN,
17 WASHINGTON, IN A REGULAR MEETING DULY ASSEMBLED, HEREWITH
18 RESOLVES THAT:
19 Section 1. The Mayor and City Clerk of the City of
20 Auburn are herewith authorized to execute the Puget Power
21 Easement so that power can be supplied to the new maintenance
22 building constructed for the Parks Department A copy of said
23 Puget Power Easement denominated as Exhibit "A" and, vicinity
24 maps denominated as Composite Exhibit "B" are attached hereto

EASEMENT FOR UNDERGROUND ELECTRIC SYSTEM
For and In consideration of one Dollar (=1.00) and other valuable consideration, the receipt of which Is hereby
acknowledged, CITY OF AUBURN, a municipal comoration ("Grantor heroin), grants, convoys and warrants to
PUGET, SOUND POWER d LIGHT COMPANYf.*,Washington corporation ("Grantee' herein), for the purposes
hereinafter set forth a perpetual easement under, across and over the folidwing dow bed real property (the
"Property' herein) King County, Washington.
See Attached Exhibit A
Except as may be otherwise set forth herein Cxaht"'s rights shall be exercised upon that portion of the Property (the
'Right-of-Way' herein) described as follows:
The West 75 feet of the above described property.

1. Purpose. Grantee shall have the right to construct operate, maintain, repair, replace and enlarge an underground
electric transmission and/or distribution system upon and under the Rightof-Way together with all necessary or
convenient appurtenances therefore, which may Include but are not limited to the following: underground oonduhs,
cables, oommunicatkm Unes; vaults, manholes, switches, and transformers; and semi-buried or ground mounted
facilities, Following the Initial construction of he faculties, Grantee may from tone to time construct such additional
facilities as it may require.
2. Access. Grantee shall have the tight of access to the Right-of-Way over and across the Property to enable
Grantee to exercise its rights hereunder, provided, that Grantee shall compensate Grantor for any damage to the
Property caused by the exercise of said right of access.
3. Obstructions; Landscaping. Grantee may from time to time remove trees, bushes, or other obstructions within
the Rightof-Way and may level and grade the Right-of-Way to the extent reasonably necessary to carry out the
purposes set forth in paragraph 1 hereof, provided, that following arty such work, Grantee shall, to the extent
reasonably practicable, restore the Right-of-Way to the condition it was immediately prior to such work Following the
installation of Grantee's underground facilities. Grantor my undertake any ordinary improvements to the landscaping
of the Rightof-Wsy, provided that no trees or other plants shall be placed thereon, which would be unreasonably

4. Grantor's Use of Right.of-Way. Grantor reserves the right to use the Rightof-Way for any purpose not
Inconsistent with the rights herein granted, provided: that Grantor shall not construct or maintain any building or other
structure on the Rightd-Way, which would Warfare with the exercise of the rights herein granted; that no digging,
tunneling or other form of construction activity, "be done on the Property, which would disturb the compaction or

5. htdsmnlty. By accepting and recording this easement. Grantee ogre" to Indemnify and hold harmless Grantor
from any and all claims for injuries and/or damages suffered by any Perim which may be caused by the Grantee's
exercise of the rights herein granted; provided that Grantee shall not be responsible to Grantor for any injuries and/or
damages to any person caused by acts or omissions of Grantor.
8. Abandonment The rights herein granted shall continue until such time as Grant" ceases to use the Right-of-
Way for a period of live (5) successive years, in which event this easement shall terminate and all rights hereunder
shall revert to Grantor, provided that no abandonment shall be doomed to have oocurred by reason of Grantee's
failure to Initially install its facilities on the RigMof•Way within any period of time from the date hereof.
7. Successors and Assigns. The rights and obligations of the parties shall Inure to the benefit of and be binding
upon their respective suaxssors and assigns.
