County, Washington, hereinafter termed "Grantee" and

WITNESSETH:

(NJThat the said Grantor for valuable consideration does by these
O presents grant unto the Grantee a perpetual right-of-way or easement
for sewer mains with the necessary appurtenances through, over and
co across the following described property situated in King County,
Washington.
That portion of the NW 1/4 of the NW 1/4 of Section 13, Town-
ship 21 North, Range 4 East, W.M. , included within the limits of a
strip of land 20 feet in width the centerline of which is described
as follows:
Beginning at the intersection of the North line of the said
NW 1/4 of the NW 1/4 with a line which is 130 feet Westerly of and
parallel with the Westerly margin of S.R. 167 as delineated on that
certain Washington State Highway Commission right-of-way drawing
S.R. 167 MP 13.66 to MP 17.42, AUBURN: 17th St. S.W. to S. 285th.
St. , sheets 5 and 6 of 30 sheets, bearing date of approval June 12,
1969 and revised September 25, 1969; thence Southerly along said
parallel line to its intersection with the South line of the said
NW 1/4 of the NW 1/4 and the terminus of said centerline description.
TOGETHER WITH a temporary construction easement 100 feet in
width the centerline of which is the same as that described above.
This easement is granted with the understanding that the Grantee shall provide a
15 foot flat gravel surface measured sout:t from the north property line of the
Thormod property, between West Valley Hig:iway and the 30 inch sanitary sewer.
This gravel surface shall be up to, but not over, Mill Creek. An additional 5 foot
permanent easement shall be given to the grantee for this purpose.
Said temporary construction easement shall remain in force
• during construction and until such time as the sewers and appur-
tenances have been accepted for maintenance and operation by the
City of Auburn.

That said Grantee shall have the right without prior
institution of any suit or proceeding at law, at times as may
be necessary, to enter upon said property for the purpose of
constructing, repairing, altering, or reconstructing said Sewer
Main, or making any connections therewith, without incurring any
legal obligation or liability therefor; provided that such con-
structing, repairing, altering or reconstructing of said Sewer
Main shall be accomplished in such a manner that the private
improvements existing in this right-of-way shall not be disturbed
or destroyed, or in the event they are disturbed or destroyed,
they will be replaced in as good a condition as they were immedi-
ately before the property was entered upon by the Grantee.
The Grantor shall retain the right to use the surface of
CD said easement, so long as said use does not interfere with the

ti no permanent buildings or structures are erected on said easement.

This easement shall be a covenant running with the land and
