ABANDONMENT OF EASEMENT RIGHTS
KNOW ALL MEN BY THESE PRESENTS THAT on the date and year set forth below, the
CITY OF AUBURN, WASHINGTON,-abandons its reservation of utility easement ri ghts as follows:
WHEREAS, the City Council adopted its Ordinance No. 5865 on August 16, 2004, recorded
under King County Recorder's Number 20041129000241, records of King County, Washington,
which Ordinance authorized the vacation of the north-south alleyway located in the Block north of
1 st Street NW, south of tad Street NW, west of North Division Street and east of "A" Stmt NW,
located within the City of Auburn, Washington.
WHEREAS, said Ordinance No. 5865 included a reservation in favor of the City of Auburn
for utility easements over, under and on the vacated right-of-way, and a reservation in favor of the
City of the right to grant easements for utilities over, under and on the vacated right-of-way, which
the City has determined that it no longer needs; and
WHEREAS, the City desires to permanently abandon and relinquish the reservation of utility
easements and easement rights ser forth in said Ordinance. NOW THEREFORE,
The CITY OF AUBURN, hereby ABANDONS and RELINQUISHES its reservation of
easements and easement rights as set forth in City of Auburn Ordinance No. 5865, adopted on
_ August l6, 2-004,_ and recorded under-King County Record's Number 20041129000241,records of
King County, Washington, to wit: easements for water and sanitary sewer utilities, communications

fiber lines, solid waste access easement, and the right to grant easements for such utilities, for, over
and across the north-south alleyway located in the Block north of 1 st Street NW, south of 2nd Street
NW, west of North Division Street and east of "A" Street NW, located within the City of Auburn,
King County, Washington, legally described as follows:
THAT PORTION OF THE NORTHEAST QUARTER OF SECTION 13, TOWNSHIP 21
NORTH, RANGE 4 EAST, OF THE WUJ AMETTE MERIDIAN IN THE CITY OF
AUBURN, KING COUNTY, WASHINGTON, SAID PORTION BEING THE ALLEY
LOCATED IN BLOCK 5 OF THE PLAT OF LW. BALLARD'S PARK ADDITION TO
SLAUGHTER AS RECORDED IN VOLUME 3, PAGE 91, RECORDS OF KING COUNTY,
WASHINGTON AND BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS:
BEGINNING AT THE NORTHWEST CORNER OF LOT 1, BLOCK 5 OF SAID PLAT;
