O'Connell, Jr. and Monicaml Made his wife, are the owners of Tracts 8, 9, and 10, Block "A", L.W. Ballard's Park Addition to Slaughter, and also the South 450.0 feet of the Westerly 382.43 feet of that portion of N.E. 1/4, N.E. 1/4, Section 13, T. 21 N. , R. 4 E.W.M. lying east of the Northern Pacific Railroad Right of Way. And WHEREAS, the City of Auburn is desirous of constructing a storm e sewer across the above described property as hereinafter described and whereas the undersigned is desireous of—granting the City of Auburn easement to construct said storm sewer. NOW THEREFORE, in consideration of the above premises, the undersigned hereby give and grant to the City of Auburn a perpetual easement to construct, operate, and maintain a storm sewer from the existing storm sewer on the Northern Pacific Railroad Right of Way approximately 240 feet north of Third Street N.W. , thence easterly to a point approximatley 5 feet west of the east line and five feet south of the north line both of Tract 8 above described; thence north parallel to the east line of the above described property to Fifth Street N.W. extended, thence east to Fifth Street N.W. The undersigned retains the right for himself and his successors to construct a building over said storm sewer provided he protect said storm sewe from damage from the building or the construction of same and provided he permits access to said storm sewer for any and all necessary maintenance and repairs; the undersigned also reserves the right to connect to this storm sewer to dispose of none polluted water.
