Situate in the City of Auburn, County of King, State of Washington. Together with the West 3 feet 'of the following described property: Lot 4, Kraus 1st Addition to'Auburn as recorded in Volume 21, Page 30 of Plats, records of King County, Washington. Situate in the City of Auburn, County of King, State of Washington. ~ That said Grantee shall have the right without prior institution of any suit or proceeding at law, at times as may be necessary, to-enter upon said easement for the purpose of_placement of roadway slopes without incurring any legal obligation or lia- bility therefor; provided that such construction shall be accomplished in such a manner that private improvements shall not be disturbed or destroyed, or in the event they are disturbed or destroyed, they will be replaced in as good a condition as they were immediately before the property was entered upon by the Grantee. This easement shall be automatically extinguished in the event grantor, its heirs,' successors, and assigns, bring the lands herein burdened by the easement to the grade of grantees nearest pavement. This easement shall be covenant running, with the land and shall be binding on the successors, heirs, and assigns of both-parties hereto. Page One DATED and SIGNED this --;2 day 1971.
