HomeMy WebLinkAbout7105060429 STREET EASEMENT 050671EASEMENT Th's easement is Quitclaimed and Granted this / p day of 1971, by King County, Washington, a political subdivision of the State of Washington, hereinafter called the Grantor, to the City of Auburn, a political subdivision of the State of Washington, hereinafter called the Grantee, as follows: 1. An Easement for public street purposes, and incidents thereto, over those portions only of the land situate in King County, Washington, heretofore conveyed by the United States of America, acting by and through the Secretary of Health, Education and Welfare to the Grantor by the quitclaim deed herein- after mentioned, the land subject to said easement is described as follows: C) Property as a whole: Lots No. 5, 6, 7, 8, 9 and 10 in block 2, lf') © Ballard Commercial Addition to Auburn. Property subject to the easement herein conveyed: Starting at the southwest corner of Lot 7, Block 2 of Ballard's Commercial Addition to Auburn, according to plat thereof recorded in Volume 29, Page 49, records of King County, Wash., thence N 19024'15" E 5.00 ft. along the west line thereof to the True Point of Beginning; thence on a curve to the right 11.88 ft., said curve having R equals 13.50 ft., Delta Angle equals 50.25'00" and Tangent equals 6.355 ft.; thence N 69041'15" E 32.60 ft.; thence on a curve to the right 22.08 ft. to the north line of said Lot 7, said curve having R equals 75.00 ft., Delta Angle equals 16.52' and tangent equals 11.12 ft.; thence S 86041115" W 52.96 ft. along the north line of said Lot 7 to the northwest corner of Lot 7; thence S 19°24'15" W 22.11 ft. along the west line of Lot 7 to the True Point of Beginning, containing approximately 300•square feet. 2. The easement herein granted is subject to the following: a. The Quitclaim Deed mentioned in paragraph 1 above from the United States of America to the Grantor, said deed being dated September 9, 1963 and recorded under Auditors File No. 5639872 in Volume 4454 at page 630, records of said King County; and b. Consent Instrument executed as of April 27, 1970 by the United States of America acting through the Secretary of Health, Education and Welfare and by said King County by John D. Spellman, County Executive and recorded January 18, 1971 under Receiving No. 0318 (7101180318), records of King County, Washington. 3. The terms and conditions hereof are as follows: The Grantee, without cost to the Grantor, shall: a. be responsible for all construction in connection with reconstruction of the street and sidewalk adjacent to the Grantors existing building. b. relocate the existing flag pole and the shrubbery and plants in locations approved by the Director of Public Health of the Grantor.
