HAMMER AND MARY ANN HAMMER, MAN AND WIFE and herein called "Grantor", and the CITY OF AUBURN, a municipal corporation, herein called "Grantee". M %D WITNESSETH: M ~•~r That in consideration of the sum of ten and no/100 Dollars ($10.00) 0 N in hand paid, receipt of which is hereby acknowledged, and the perfor- mance by the Grantee of the covenants hereinafter set forth, Grantor hereby grants unto Grantee, a permanent easement for the construction of a Municipal Water Storage Reservoir together with supply and drainage lines, pumps and other items necessary to operate said reservoir in conjunction with the CITY OF AUBURN's Municipal Water System. Said permanent easement shall be over, upon and under the following described property: UNDERGROUND RESERVOIR, SUPPLY & DRAINAGE LINE EASEMENT Portion of Lots 3 and 12, togetiaer with portion of vacated street adjacent C.D. Hillman's Green River Addition Division No. 1, recorded in volume 17, page 67 records of King County, Washington, lying in the NE 1/4 of the NW 1/4 of Section 17, Township 21 North, Range 5 East W.M. and is described as follows: Beginning at the N.E. corner of lot 12 C.D. Hillman's Green River Addition Div. No. 1 and the westerly right-of-way line of 105th P1. S.E.; thence southeasterly along the westerly R/W line of 105th P1. S.E. 367.00 ft. to the true point of beginning; thence continuing along said westerly R/W line 163.0 ft more or less to C~11 Reservoir #2 Easement -2- The Northerly R/W line of 106th Ave. S.E.; thence southwesterly along said northerly R/W line 90.00 ft. more or less to the south- east corner of lot 12 C.D. Hillman's Green River Addition Div. No. 1; thence along the south boundary of said lot 12 160.00 ft; thence northerly parallel to the westerly boundary of lot 12 C.D. Hillman's Green River Addition 185.00 ft.; thence easterly and parallel to the south boundary of said lot 12 180.00 ft. to westerly R/W line of M 105th P1. S.E.; thence southeasterly along said R/W line and the easterly boundary of lot 12 said plat 367.00 ft.; thence westerly and parallel to the south boundary of said lot 12 136.00 ft. to the true poing of beginning of the center- line of a 20.00 ft. wide permanent utility easement; thence continuing on a defelction angle to the rt. of 51° - 30' - 00" northwesterly a distance of 82.00 ft.; thence continuing northwesterly on a deflection angle to the rt. of 13° - 00' - 00" a distance of 94.0 ft.; thence northwesterly on a deflection angle to the left of 4° - 00' -00" a distance of 133.0 ft.; thence northwesterly on a deflection angle to the left of 12° - 00' - 00" a distance of 121.0 ft.; thence continuing ~i Reservoir ##2 Easement -3- c~ c O err N C e-~ i` northwesterly on a deflection to the left of 7° - 45' - 00" a distance of 108.0 ft.; thence northwesterly on a deflection angle of 18° - 15' - 00" to the southeasterly R/W line of Lee Hill Rd. and the termination of said 20' permanent utility easement; together with a temporary easement for construction purposes over the above described perman- ent easement centerline, said temporary easement being 40 ft.wide in width and parallel with above described centerline. It is specifically understood that this easement shall not prohibit the use of the property for open space or outdoor recreation purposes in conjunction with the development of the adjacent properties, provided, however, that no structures, recreation equipment or development shall occur on said easement without the consent of the grantee. It is further understood that this easement and the conditions herein shall be binding on the grantor's heirs, successors and assigns.
