McCurdy, as trustee, for and. in eq consideration of ONE DOLLAR in hand paid., receipt of which is hereby acknowledged, hereby conveys and quit claims to the City of Auburn, a municipal corporation of King County.,, Washington, a 15-foot easement over, through, under and across the following described real property situated. in King County, Washington: The West 15 feet of the East 115 feet of the Southeast 4 of the Southwest 4 of .a+'erc M.on ,1W, Township 21 North, Range 4, East W.M., except that portion lying within Primary State Highway No. 2 which right-of-way is described by deed recorded Auditor's file No. 4590824, records of said county, also The Easterly 15 feet in width of that ortion of the East 2 of the Northwest of Section 24, Township 21 North, Range 4 East W.M., lying westerly of the right-of-way of the Seattle-Tacoma Interurban Railway, also sometimes known as Puget Sound Electric Railway, except County roads. for the construction, operation, maintenance, repair or replacement of sewer mains. Such construction, operation, maintenance, repair or replacement shall be accomplished in such manner that the private improvements from time to time existing within the described.ease- ment shall not be disturbed, damaged. or destroyed, In the event they are disturbed, damaged or destroyed, the Grantee shall replace such improvements in as good condition as they were prior to entry by the Grantee. The aforementioned easement is a non-exclusive easement and is given on the condition and undertaking of the Grantee that all sewer facilities shall be laid. underground. The Grantee further agrees to indemnify and save harmless the Grantor, his heirs, executors, and assigns, from any liability arising out of the activities of the Grantee contemplated hereunder and all costs, legal fees, and. other expenses incurred by Grantor, its heirs or assigns, as a result thereof.
