McCurdy, as Trustee, for and in consideration of One Dollar, in hand paid, receipt of which is X X hereby acknowledged, hereby conveys and quit claims to the City L 4 of Auburn, a municipal corporation of King County, Washington, a 15-foot easement over, through, under and across the following described real property situated in King County, Washington: The West 15 feet of the East 115 feet of the Southeast 1/4 of the Southwest 1/4 of SQCiti;: .k113,1Y Township 21 North, Range 4, East W.M., except that portion lying within Primary State Highway No. 2, which right-of-way is described by deed recorded under Auditor's File No. 4590824, records of said county, also The Easterly 15 feet in width of that portion of the East 1/2 of the Northwest 1/4 of Section 24, Township 21 North, Range 4 East, W.M., lying westerly.of the right-of-way of the Seattle- Tacoma Interurban Railway, also sometimes known as Puget Sound Electric Railway, except County roads, for the construction, operation, maintenance, repair or replacement of water mains. Such construction, operation,.maintenance, repair or replacement shall be accomplished in such manner that the private improvements from time to time existing within the described ease- ment shall not be disturbed, damaged or destroyed. In the event they are disturbed, damaged or destroyed, the Grantee shall replace such improvements in as good condition as they were prior to entry t by the Grantee. The aforementioned easement is a non-exclusive easement and is given on the condition and undertaking of the Grantee that all water facilities shall be laid underground. The Grantee further agrees to indemnify and save harmless the Grantor, his heirs, executors and assigns, from any liability arising out of the activities of the Grantee contemplated hereunder and all costs, legal fees, and other expenses incurred by Grantor, its heirs or assigns, as a result thereof. -1- W L ~ VOL ON E 33 7 It is specifically understood that this easement shall 0711 not prohibit the use of the property as a paved parking lot or roadway by the Grantor.
