THIS AGREEMENT made this S9 N day of AStosv , 1972, by and
r-'-\\ between the CITY OF AUBURN, a municipal corporation of King County, Washington, here-
inafter termed "GRANTEE", and Lorne McCOMB and Mary E. McCOMB, his wife, hereinafter
termed "GRANTOR".
WITNESSETH:

THAT THE said GRANTOR for valuable consideration does by these presents grant
qT unto the GRANTEE a SLOPE EASEMENT with the right to make all necessary slopes upon
L the abutting property for cuts and fills as may be required in the construction of

The SLOPE EASEMENT is described as follows:
Those portions of the Tax Lots 26 and 252 situate in the SW 114 of Sec 18, Twp
21N, RSEWM, lying West of the follow ng described line: Beg at a pt on the S bound-

line of "A" Street SE as hereinafter described; th proceeding Nly to a pt on the N

THAT SAID GRANTEE shall have the right without prior institution of any suit or
proceeding at law, at times as may be necessary, to enter upon said easement for the
purpose of placement of roadway slopes without incurring any legal obligation or lia-
bility therefor; provided that such construction shall be accomplished in such a man-
ner that private improvements shall not be disturbed or destroyed, or in the event
they are disturbed or destroyed, they will be replaced in as good a condition as they
were immediately before the property was entered upon by the GRANTEE.
THIS EASEMENT shall be automatically extinguished in the event Grantor, its heirs,
successors, and assigns, bring the lands herein burdened by the easement to the grade
of GRANTEE's nearest pavement.
THIS EASEMENT shall be covenant running with the land and shall be binding on the
successors, heirs, and assigns of both parties hereto.
