Feist and CU 'a Mary A. Feist his wife, hereinafter termed "Grantor", WITNESSETH: That the said Grantor for valuable consideration does by these presents grant unto the Grantee a slope easement with the right to make all necessary slopes upon the abutting property for cuts and fills as may be required in the construction of roadway improvements on West Valley Road. The slope easement is described as follows: The Easterly 30 feet (measured at right angles to the margin of West Valley Road) of the Northerly 200 feet of the following described parcel: The South 16.5 acres of the East 1/2 of the Southeast 1/4 of the Northwest.. 1/4 of Sec. 23 Township 21 North, Range 4 East, W.M., King County, Washington, less State Road No. 69. That said Grantee shall have the right without prior institu- tion of any suit or proceeding at law, at times as may be necessary, to enter upon said easement for the purpose of constructing roadway improvements without incurring any legal obligation or liability therefor; provided that such construction shall be accomplished in such a manner that private improvements shall not be disturbed or destroyed, or in the event they are disturbed or destroyed, they will be replaced in as good a condition as they were immediately before the property was entered upon by the Grantee. This easement shall be a covenant running with the land and, shall be binding on the successors, heirs, and assigns of both parties hereto. 42 ti .
