WELLS and L.ILLIAN,H. WELLS, his wife and his wife, ~ ereinafter termed "Grantor", .10 WITNESSETH: wq' •17 That the said Grantor for valuable consideration does by these presents grant unto the Grantee a slope easement with the right. to make all necessary slopes upon the abutting property for cuts and fills as may be required in the construction of roadway improvements on West Valley Road. The slope easement is described as'follows:• The west 10 feet, measured perpendicularly to West Valley Road, of the following described parcel: -That portion of the north half of the northwest quarter of the northeast quarter of Section 23, Township 21 north, Range 4 east, W.M., described as follows: Beginning at the northeast corner of said Section 23,; thence south 89°58'15" west along the north line of said Section 23, a distance of 1315.84 feet to the 1/16 section corner; thence south 0042'21" west 12.00 feet; thence south 89°58'l5 west, parallel to said north line of section 23, a distance of 528.65 feet to the true point of beginning of the tract of land herein described; thence south 0°01145" east 208.71 feet; thence south 89°58'15" west 269.08 feet to the easterly line of State Highway; thence north 30001'15" east, along said easterly line 241.12 feet to a point from which the trice point of beginning bears North 89°58'15" east; thence north 89°58'15" east 148.34 feet to the true point of beginning. Easement No. 9 Arthur & Lillian Wells That said Grantee shall have the right without prior institu- tion of any suit or proceeding at law, at tines as may be necessary, t to enter upon said easement for the purpose of construction road,va_v improvements without incurring any legal obligation or liability therefor; provided that such construction shall be accomplished in suchia manner that private improvements shall not be disturbed or destroyed, or in the event thev are disturbed or destroyed, they will be renlaced in as good a condition as they were immediately before the propor_ty was entered upon by the Grantee.
