THIS AGREEPENT made this 23 day of September 19 68 , by and
between the CITY OF AUBUPS1, a municipal corporation of King County,
Washington, hereinafter termed "Grantee" and
Frank _J. Pful9 and
. Teresa M. Pful g. his wife,
hereinafter termed "Grantor",
WITNESSETH:
That the said Grantor for valuable consideration does by these
presents grant unto the Grantee a slope easement with the right to
make all necessary slopes upon the abutting property for cuts and
fills as may be required in the construction of roadway improvements
on West Valley Road.
The slope easement is described as follows:
The east 15 feet measured at right angles to the west margin
of West Valley Road of the following described parcel:
All that portion of the South Half of the Northwest Quarter
of the Northeast Quarter of Section 23, Township 21 North,
Range 4 East, W.M. lying west of West Valley Road, and that
portion of a 15 foot wide parcel adjacent to the west margin.of
West Valley Road, and measured perpendicularly to said road,
that lies in Northwest Quarter of said Section 23 and 150 feet
north of the south line of the =.Nov-*cli--1/2 .-of said section quarter.
Easement No. 6
That said Grantee shall have the right without prior institu--
tion of any suit or proceeding at late, at times as may bo necessary,
to enter upon said easement for the purpose of construction roadway
improvements without incurring any legal obligation or liability
therefor; provided that such construction shall be accomplished in
such a manner that private improvements shall not be disturbed ' or
destroyed, or in the event they are disturbed or destroyed, they
will be replaced in as good a condition as they were immediately
before the property was entered upon by the Grantee.
This easement shall be a covenant running with the land and
shall be binding on the successors, heirs, and assigns of both
parties hereto.
