HomeMy WebLinkAbout6429611 SLOPE EASEMENT 110468612961 1 5164 411 E A S E hl E N T , THIS AGREEMENT made this Isfi day of October 1968 by and between the CITY OF AUBURN, a municipal corporation of King County, Washington, hereinafter termed "Grantee" and S. M. Murakami and H i .I:eko Murakami , h i s wife, herein- after termed "Grantor", WI TNESSETH: That the said Grantor for valuable consideration does by these presents grant unto the Grantee a slope easement with.the right to make all necessary %0 slopes upon the abutting property for cuts and fills as may be required in the construction of roadway improvements on West Valley Road. The slope easement is described as follows: Beginning at the point of intersection of a line parallel to and 353 ft south of the north line of the South half of the North half of the Northeast Quarter of Section 23, Township 21 North, Range 4 East, W.M. and the east margin of the West Valley Road; thence southerly along the east margin of said Road a distance of 30 ft measured along the arc of a simple curve the radius of which is 924.93 feet; thence southeasterly at right angles to the point of tangency of said curve a distance of 15 feet along the radial line; thence northerly along an arc of radius 909.93 feet, said arc being parallel to and 15 feet from the easterly margin of West Valley Road, to the point of intersection of a line parallel to and 353 feet south of the north line of the South Half of the North Half of the Northeast Quarter of said Section 23; thence westerly along said line to the point of beginning, and the westerly 10 feet of the following described parcel: Beginning at the intersection of the north line of the South Half of the North Half of the Northeast Quarter of Section 23, Township 21 North, Range 4 East W.M., with the east margin of the West Valley Road; thence North 88058'00" East along the center line of the ditch marking the said above mentioned line for 1157 feet to the center line of the main Pacific City Ditch; thence South 20043100" West along said ditch centerline for 709 feet; thence South 0025100" West along the centerline of said ditch for 168 feet; thence South 87001100" West for 590 feet to the centerline of a field road- way; thence South 0042100" West along said centerline for 160 feet; thence South 8701'00" West to the east margin line of the West Valley Road; thence northerly along said margin line to the point of beginning, and except the following described tract: Beginning at the intersection of the north line of the South Half of the North Half of the Northeast Quarter of Section 23, Township 21 North; Range 4 East; W.M., with the east margin of West Valley Road; thence North 88058100" East along the north line of said subdivision 650 feet; thence South 0042'00" West 353 feet; thence South 88058'00" West to the east margin of said West Valley Road; thence northerly along said east margin to the point of beginning. . That said Grantee shall have the right without prior institution of any suit or proceeding at law, at times as may be necessary, to enter upon said easement for the purpose of construction roadway improvements without incurring any legal obligation or liability therefore; provided that such construction shall be accomplished in such a manner that private improvements shall not be disturbed or destroyed, or in the event they are disturbed or destroyed, they will be replaced in as good condition as they were immediately before the property was entered upon by the Grantee. This slope easement may be terminated when the grantor or his successors, heirs and assigns shall fill the adjacent property to the roadway level and a request for a change of land use classification has been granted. The grantee will provide roadway drainage as required when the adjacent property has been filled and a request for change of land use classification has been granted. Said drainage will be provided along the East shoulder of the West . J164 41.8 ti^ Valley Highway between Highway Stations 26 and 62 and 30 and 85 as shown on the plans of the City of Auburn, West Valley Highway improvements, prepared by Hill, Ingman, Chase and Company in 1968.
