E A S E M E N T
THIS AGREEMENT made this lst day of October 1968 , by and
between the CITY OF AUBURN, a municipal corporation of King County,
Washington, hereinafter termed "Grantee" and
Wells B. McCurdy, Trustee
~r hereinafter termed "Grantor",

WITNESSETH:
That the said Grantor for valuable consideration does by these
presents grant unto the Grantee a slope easement with the right to
make all necessary slopes upon the abutting property for cuts and
fills as may be required in the construction of roadway improvements
on West Valley Road.
The slope easement is described as follows:
Beginning at the intersection of a line 20 feet north of the
south line of the Northeast Quarter of Section 23, Township 21 North,
Range 4 East, W.M. and the easterly margin of West Valley Road
which is the true point of beginning of said easement; thence north-
westerly along the easterly margin of said West Valley Road a
distance of 600 feet; thence northeasterly a distance of 10 feet
measured at right angles to the margin of said Road; thence south-
easterly along a line parallel to and 10 feet from the easterly
margin of said Road to a point on a line 20 feet north of the
south line of the Northeast Quarter of said Section 23, thence
westerly along said line to the true point of beginning.
That said Grantee shall have the right without prior institu-
tion of any suit or proceeding at law, at times as may be necessary,
to enter upon said easement for the purpose of construction roadway
improvements without incurring any legal obligation or liability
therefor; provided that such construction shall be accomplished in
such a manner that private improvements shall not be disturbed or
destroyed, or in the event they are disturbed or destroyed, they
will be replaced in as good a condition as they were immediately
before the property was entered upon by the Grantee.
This easement shall be a covenant running with the land and
shall be binding on the successors, heirs, and assign "f both
