HomeMy WebLinkAbout6429614 SLOPE EASEMENT 110468642963-4 ; 5164 423 E A S E M E N T THIS AGREEMENT made this 3rd day of October , 1968 , by and .between the CITY OF AUBURN, a municipal corporation of King County, Washington, hereinafter termed "Grantee" and George Murakami and Cora Murakami his wife, hereinafter-termed-"Grantor", WITNESSETH: That the said Grantor for valuable consideration does by these presents grant unto the Grantee a slope easement with the right to make all necessary slopes upon the abutting property for cuts and fills as may be required in the construction of roadway improvements on west Valley Road. The slope easement is described as follows: The west 15 feet of the following described parcel: Beginning at the intersection of the north line of the South Half of the North Half of the Northeast Quarter of Section 23, Township 21North, Range 4 East, W.M. with the east margin of West valley Road; thence North 88058"00" East along the north line of said subdivision 650 feet, thence S 0042'00" West 353 feet; thence South 88058100" West to the East margin of said West Valley Road; thence northerly along said easterly margin of said West Valley Road to the point of beginning. kri That said Grantee shall have the right without prior institution of any suit or proceeding at law, at times as may be necessary, to enter upon said easement for the purpose of construction roadway improvements without incurring any legal obligation or liability therefore; provided that such construction shall be accomplished in such a manner that private improvements shall not be disturbed or destroyed, or in the event they are disturbed or destroyed, they will be replaced in as good a condition as they were immediately before the property was entered upon by the Grantee. This slope easement may be terminated when the grantor or his successors, heirs and assigns shall fill the adjacent property to the roadway level and a request for a change of land use classification has been granted. The grantee will provide roadway drainage as required when the adjacent property had been filled and a request for change of land use classification has been granted. Said drainage will be provided along the East shoulder of the West Valley Highway between Highway Stations 26 and 62 and 30 and 85 as shown on the plans of the City of Auburn, West Valley Highway improvements, prepared by Hill, Ingman, Chase and Company in 1968.
