For and in consideration of Nine Hundred•-an'd"146/100 Dollars ($900.00) and
other good and valuable consideration in hand paid, receipt of which is
hereby acknowledged, and for benefits to be derived by the Grantor herein,
Grantor, Harold Allen McMasters and Ruth Helen McMasters, husband and wife
and Stephen G. Allen and Margaret L. Allen husband and wife and as contract
purchasers, hereby conveys and warrants to the City of Auburn, a Municipal
Corporation of the State of Washington, its successors and assigns, a
perpetual nonexclusive easement under, over, through and across the
following described land for the purpose of laying, maintaining, and
installing a traffic signal pole and appurtenances thereof, said land being
described as follows:
THAT PORTION OF GOVERNMENT LOT NO. 5 IN THE NORTHEAST QUARTER OF
THE NORTHWEST QUARTER OF SECTION 19, TOWNSHIP 21 NORTH, RANGE 5
EAST, W.M. DESCRIBED AS FOLLOWS:
BEGINNING AT THE SOUTHEAST CORNER OF SAID GOVERNMENT LOT NO.

SAID GOVERNMENT LOT NO. 5 A DISTANCE OF 314.47 FEET TO A

A G R E E M E N T
THIS AGREEMENT, entered into this 11th day of September , 1973,
by and between the City of Auburn, a municipal corporation of the State of
Washington, hereinafter referred to as "CITY" and Kenneth W. and Algretta
1. Sorensen , hereinafter called "OwwER".
W I T N E SSE T H: That
WHEREAS, a parcel of unimproved street right-of-way lies adjacent to
the owner property legally described as follows; and
The East 23.5 feet of South 389.7 feet of West 112 of SW 114 of NE 114
of SW 114 togetherwith West 88 feet of South 389.77 feet of East 112 of
SW 114 of NE 114 of SW 114 LESS North and South 30 feet for Streets,
Block 9138, Code 0120 Section 19, Twp 21, Range 5.
WHEREAS, the owner desires to gravel that portion of the street :right•-cf-
way adjacent to the north side of the aforesaid legally described property
and use same for vehicular access to their property,
NOW, WHEREFORE, THIS AGREEMENT WITNESSETH THAT FOR ANDPIN CONSIDERATION
OF THE MUTUAL BENEFITS TO EACH OF THE OWNERS, THEIR RESPECTIVE SUCCESSORS AND
ASSIGNS DO HEREBYkCOVENANT AND AGREE AS FOLLOWS:
SECTION 1. City agrees to allow Owner to gravel that portion of the Street
right-of-way adjacent to the north side of the aforesaid legally described pro-
perty. To provide access to said property.
SECTION 2. Owner agrees to participate and sign a petition to create a Local
Improvement District for street construction when initiated by the City or adjacent
property owners.
SECTION 3. It is understood that the provisions of this agreement shall be
enforceable against Owners, their Successors, and Assigns of the property herein
described.
