GRANQUIST AND WANDA L. GRANQUIST, WITH THE PROVISO THAT A NON-REMONSTRANCE AGREEMENT BE ENTERED INTO WITH THE OWNERS FOR A FUTURE SEWER LOCAL IMPROVEMENT DISTRICT ON 17TH STREET S.E., WITHIN THE CITY OF AUBURN, WASHINGTON. THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, IN A REGULAR MEETING DULY ASSEMBLED, HEREWITH RESOLVES THAT: THE Mayor and City Clerk of the City of Auburn, Washington, are herewith authorized to execute an Easement between the City and JAMES J. GRANQUIST and WANDA L. GRANQUIST with the proviso that a Non-remonstrance Agreement be entered into with the owners for a future sewer Local Improvement District on 17th Street Southeast, within the City of Auburn. Copies of said Agreement and Non-remonstrance Agreement are attached hereto, denominated as Exhibits "A" and "B" and made a part hereof as though set forth in full herein. Resolution No. 1903 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor and City Clerk of the City of Auburn, to execute a pay back agreement between the City of Auburn and the Delco Group for water and sanitary facilities on property located at 12515 S.E. 312th, within the City of Auburn, Washington. Motion by Councilmember Larson, second by Councilmember Walters to approve Resolution No. 1903. MOTION CARRIED UNANIMOUSLY. 7-0. 2. Resolution No. 1906 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor and City Clerk of the City of Auburn, to execute an agreement between the City of Auburn and Leonard Gus Associates for the purpose of a Downtown Market Study. Motion by Councilmember Whittall, second by Councilmember Brothers to introduce and approve Resolution No. 1905. MOTION CARRIED UNANIMOUSLY. 7-0. Resolution No. 1908 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor and City Clerk to execute an airport dealer supply contract between the City of Auburn and Chevron U.S.A., Inc., a California Corporation, for supply of aviation fuel for the Auburn Municipal Airport. Motion by Councilmember Larson, second by Councilmember Walters to approve Resolution No. 1908. MOTION CARRIED UNANIMOUSLY. 7-0. 4. Resolution No. 1910 A Resolution of the City Council of the City of Auburn, Washington, amending Resolution No. 1882 to reflect a change in the easement between the City and James J. GRANQUIST AND WANDA L. GRANQUIST, WITH THE PROVISO THAT A NON-REMONSTRANCE AGREEMENT BE ENTERED INTO WITH THE OWNERS FOR A FUTURE SEWER LOCAL IMPROVEMENT DISTRICT ON 17TH STREET S.E., WITHIN THE CITY OF AUBURN, WASHINGTON, AND AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE SAID EASEMENT. WHEREAS, City of Auburn Resolution passed August 1, 1988, authorized the Mayor and City Clerk to execute an Easement between the City and JAMES J. GRANQUIST and WANDA L. GRANQUIST, with the proviso that a Non-Remonstrance Agreement be entered into with the owners for a future sewer Local Improvement District on 17th Street S.E., within the City of Auburn, Washington; and WHEREAS, it is now necessary to correct the Easement to reflect the granting of 15 feet rather than 10 feet to the Grantees, JAMES J. GRANQUIST and WANDA L. GRANQUIST, for ingress and egress and for the purpose of laying, maintaining, and installing a sanitary side sewer. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, IN A REGULAR MEETING DULY ASSEMBLED, HEREWITH RESOLVES THAT: THE Mayor and City Clerk of the City of Auburn, Washington, are herewith authorized to execute an Easement between the City and JAMES J. Granquist and Wanda L. Granquist, husband and wife, whose address is 2935 - 17th Street S.E., Auburn, Washington 98002, as record Owner(s), of real property legally described as follows: Lot 25, Block # 7, Plat of Forest Villa as recorded in Volume 62 of Plats, Pages 15 and 16, Records of King County, Washington, situate in SE 1/4 of NE 1/4 of :.Section 20, Township 21 North, Range 5 East, W.M. in the City of Auburn, County of King, State of Washington. In consideration of the conditions herein, the parties agree as follows: 1. APPROVAL. The Owner has requested City approval of the following specified application: Sanitary Sewer Connection Permit to existing City sewer line in Fir Street S.E. (which does not border above real property) in lieu of extending 8 inch public sewer in 17th Street S.E. adjacent to property at this time and connecting to this new sewer line. The City hereby approves the Owner's application subject to the following con- ditions: A. The Owner agrees to execute this agreement and agrees to be bound by the terms of this agreement, and B. The Owner agrees to comply with City ordinances and regulations in development of the property. 2. LID WAIVER. The parties understand the public interest may require creation of a Local Improvement District (hereafter "LID") for installing a sanitary sewer designed to serve the above-described property. The City's approval of the Owner's application is subject to the Owner's agreement as follows: Whenever a Local Improvement District is proposed for the installation of a sanitary sewer designed to serve the above-described property, whether by petition or resolution, the Owner agrees on its own behalf and on behalf of its successors in interest, and heirs and assigns, not to protest the establishment of any LID nor challenge the assessments levied therefore on the basis of lack of special benefit from the Improvement. 3. COVENANT RUNNING WITH THE LAND. This agreement shall be binding on the Owner, its successors, heirs and assigns, and is a covenant running with the land. Owner agrees to pay all fees for recording this agreement with the King County Auditor. If it becomes necessary for the City to enforce any of the hereinabove provisions of this Agreement, the owners, their successors and assigns, hereby covenant and agree to pay the City all reasonable attorney fees and costs incurred by the City to enforce the pro- visions of this Agreement.
