Meade a Widow , do hereby grant and convey to the City of Auburn, a municipal corporation, a slope ease- ment over and across, upon and underneath, the following described land for cuts and fills, as may be required in the construction of Auburn Way North A.K.A. P.S.N. No. 5 and the relocated Howard Road , said land being described as: THAT PORTION OF THE SOUTHWEST ONE QUARTER OF THE SOUTHEAST ONE QUARTER OF SECTION 20; TOWNSHIP 21 NORTH, RANGE 5 EAST, W.M. LYING SOUTHERLY OF STATE HIGHWAY 164, ALSO KNOWN AS AUBURN WAY SOUTH, AND LYING NORTHERLY OF THE AUBURN ENUMCLAW ROAD NO. 1001, ALSO KNOWN AS HOWARD ROAD, AND LYING EASTERLY OF THE RELOCATED HOWARD ROAD AS DESCRIBED IN QUIT CLAIM DEED RECORDED UNDER KING COUNTY AUDITOR'S FILE NO. 7708250768 DESCRIBED AS FOLLOWS: C A 5.00 FOOT STRIP OF LAND, THE NORTHERLY BOUNDARY OF WHICH ABUTS AND ADJOINS THE C7 SOUTHERLY MARGIN OF SAID AUBURN WAY SOUTH. TOGETHER WITH A 5.00 FOOT STRIP OF LAND, THE WESTERLY BOUNDARY OF WHICH ABUTS AND ADJOINS THE EASTERLY BOUNDARY OF SAID RELOCATED HOWARD ROAD. IT IS UNDERSTOOD AND AGREED THAT, IN THE EVENT THE GRANTOR, HIS HEIRS, OR (7) ASSIGNS, SHALL EXCAVATE AND/OR PLACE AN EMBANKMENT UPON THE AREA COVERED BY THIS Q0 SLOPE EASEMENT TO THE LEVEL OF THE GRADE OF THE ABOVE-MENTIONED HIGHWAY AND ROAD ABUTTING THEREON, ALL RIGHTS OF THE GRANTEE HEREIN SHALL CEASE AND TERMINATE. Said Grantee shall have the right, without prior institution of any suit or proceeding at law, at times as may be necessary, to enter upon said easement for the purpose of constructing roadway improvements without incurring any legal obligation or liability therefor; provided that such construction shall be accomplished in such a manner that private improvements shall not be disturbed or destroyed, or in the event they are disturbed or destroyed, they will be replaced in as good a condition as they were immediately before the property was entered upon by the Grantee.
