EASEMENT
THIS AGREEMENT made this 28th day of November, 1962, by and
etween City of Auburn, a municipal corporation of the State of
Washington, hereinafter termed "Grantee," and Melvin Kelley,
hereinafter termed "Grantor":
WITNESSETH: That the said Grantor for valuable consideration
does by these presents grant unto Grantee a perpetual right-of-
way and easement for utilities through and across the following
described property situated in King County, Washington, more par-
ticularly described as follows:
An easement for utilities five (5) feet on each side
of the centerline described as follows:
Beginning at a point on the North line of Lot 3,
Block 3, Kelley Manor according to plat of record
in King County Auditor's office, said point being
14.67 ft. west of NE corner said lot, thence
S 24055' E to eastline said Lot 3, thence South
along said east line to 33rd Street S. E.
Property situated in the County of King, State of
Washington.
The said Grantee shall have the right without prior institu-
any
tion of/suit or proceedings at law, at times as may be necessary,
to enter upon said property for the purpose of constructing, re-
pairing, altering or reconstructing utilit'ies:~lines therein, or
making any connections therewith, without incurring any legal
obligation or liability therefor; provided that such constructing,
repairing, altering or reconstructing of said utility mains shall
be accomplished in such a manner that the private improvements
existing in this right-of-way shall not be disturbed or destroyed,

or in the event they are disturbed or destroyed, they will be
replaced in as good a condition as they were immediately before
the property was entered upon by the Grantee.
The Grantor shall retain the right to use the surface of
said easement, so long as said use does not interfere with the
installation and maintenance of the utility mains and so long as
no buildings or structures are erected on said easement.
This easement shall be a covenant running with the land and
shall be binding on the Grantor's successors, heirs and assigns.
