HomeMy WebLinkAbout6472799 SEWER EASEMENT 012069L~~ .zl9 5203 A: E A S E M E N T PUGET SOUND POWER & LIGHT COMPANY, a Washington corporation, does hereby grant and convey to the CITY OF AUBURN, a municipal corporation, an easement over and across, upon and underneath, the following described land, for Ingress and egress and for the purpose of laying, maintaining, and installing a sewage lift station and connecting sewer lines, said land being described as: Starting at the northwest section corner of'q Township 21 North, Range 5 East W.M., King County, Washin~,t n; thence {T S 0°45'10" W. 30 feet along the west line of said subdivision; ` thence S 89°54'03" E. 224 feet to the point of beginning; thence O r N S 89°54'03" E. 16 feet on a line that is parallel with the north f'' line of said subdivision; thence S 0°45'10" W. 44 feet on a line 41-T that is parallel with the west line of said subdivision; thence 1Z N 89°54'03" W. 16 feet; thence N 0°45'10" E. 44 feet to the point of beginning. It is understood and agreed that this easement shall not affect building and/or structure set-back requirements by the City of Auburn, and the vault will be placed on the South 26' of this Easement with entrance manhole centered 8' West of East line and 8' North of South line of vault. Manholes only to be above ground level. ( J ] J This easement is granted on the following terms and conditions: ~ 1. Grantee agrees to save and hold Grantor harmless from all loss or damage which may be due to the exercise by Grantee of the right herein granted and from all claims for such damage by whomsoever made and to indemnify Grantor for all such loss, damage and claims. 2. Grantor reserves the right to use said land for its own purposes in any way, and to grant rights in said land to others, not inconsistent with the right herein granted to Grantee, and Grantee hereby assumes all risk of loss or damage, including damage or injury to persons or to property, which may be suffered by Grantee resulting from Grantor's use of said land and any of its equipment thereon, whether said damage or injury be due to the negligence of Grantor, its servants or agents, or otherwise. 3. The right hereby granted shall cease and determine whenever Grantee shall have permanently abandoned the use of said facility and upon such abandonment Grantee shall remove its facility and restore the premises to as good a condition as they were in prior to the construction of said facility. 4. Grantee agrees to pay any and all taxes assessed against its said facility and shall reimburse Grantor for any increase in taxes payable by Grantor which is based upon an increase in land valuation occasioned by the installation and mainten- ance of Grantee's said facility. 5. If the Grantee, its successors or assigns makes an excavation in the Grantor's property, it shall without delay restore the surface as nearly as practicable to the same condition as it was in before the doing of such work. 6. No assignment of ;the privileges and benefits accruing to the Grantee here- under, by operation of law or otherwise, shall be valid without the prior written consent of the Grantor. 7. The location of said right of way is shown on Map No. dated , 19 , prepared by I copy of which is attached hereto and by this reference made a part hereof.
