THIS EASEMENT AND AGREEMENT made and entered into this _I day of
GcAb~5zc , 19 `1`6 , by and between the City of Auburn, a municipal corporation of
King County, Washington, hereinafter referred to as "CITY" and Mildred Danner, located at
100222 nd St. NE, Auburn, WA 98002, hereinafter referred to as "PROPERTY OWNER".
WHEREAS, PROPERTY OWNER has applied for certain permits with the CITY for the
construction of facilities at 307 Oravetz Place SE, Auburn, WA 98002 which create impervious
surface; and
WHEREAS, the PROPERTY OWNER will complete a storm system; and
WHEREAS, the PROPERTY OWNER and the CITY desire that the storm system be
maintained to provide adequate facilities for controlling both the quantity and quality of storm
drainage; and
WHEREAS, for maintenance of a storm system it is necessary to have appropriate right-
of-way to bring in equipment to conduct maintenance .functions; and
WHEREAS, maintenance requirement is a covenant running with the land and binding
upon all heirs, successors and assigns of both parties; and

WHEREAS, the parties desire that this Agreement be recorded to advise heirs, successors
and assigns of both parties as to the existence of this easement and agreement; and
WHEREAS, an easement is needed to bring in maintenance equipment; and
WHEREAS, the parties are both desirous of permitting inspection of the storm system to
make certain that it is functioning properly and for purposes of determining the appropriate
repairs.
O NOW, THEREFORE, BASED UPON MUTUAL COVENANTS TO BE DERIVED

l~ THE PARTIES AGREE AS FOLLOWS:

Section 1, EASEMENT

PROPERTY OWNER hereby provides an easement over, under and on that portion of the
property as showing on the approved Record Drawings revised pursuant to construction records
for the City of Auburn under Permit No(s). FA00003-98 and BLD0014-98, which Record
Drawings are hereby incorporated by reference as if set out in full. This easement shall be a
burden to that real estate which is legally described and attached as Exhibit A and incorporated
herein by this reference, and shall be of benefit to the City storm utility system.
Section 2, HEIRS, SUCCESSORS AND ASSIGNS
This Agreement shall be binding upon the heirs, successors and assigns of the parties.
Section 3, MAINTENANCE
The PROPERTY OWNER agrees to maintain the storm system in accordance with the
ordinances and all applicable codes of the CITY and the Stormwater Pollution Prevention
Maintenance and Operation Schedule attached as Exhibit "B" and incorporated herein by this
reference. The PROPERTY OWNER does hereby agree that the CITY may enter onto the
property of the PROPERTY OWNER via the easement described above to inspect and perform
necessary maintenance if, after the PROPERTY OWNER is given notice to maintain, the
PROPERTY OWNER fails to maintain. Further, the PROPERTY OWNER agrees the CITY
may enter onto the property of PROPERTY OWNER via the easement described above to
perform emergency maintenance in the event of the storm system's failure which might result in
adverse impacts(s) on public facilities or private facilities of other property owners. In both
events the PROPERTY OWNER agrees he/she/they/it shall reimburse the CITY for the costs
incurred by the CITY in maintaining the storm system. Should the CITY incur attorney's fees
and/or costs in enforcing the agreement and/or in maintaining or collecting maintenance fees, the
PROPERTY OWNER agrees to pay reasonable attorney's fees and all costs incurred by the
CITY.

Section 4, ACKNOWLEDGMENT OF OTHER ENFORCEMENT ACTIONS
PROPERTY OWNER acknowledges that there may be liability for violations of codes
that could result in additional fines and/or the possibility of incarceration in addition to the fees
for maintenance should violations occur.

Introduction
The project consists of the addition of a new manufacturing building and
associated roads and parking for an existing manufacturing park. The project is located
on a six acre parcel adjacent and south of the White (Stuck) River in Auburn,
Washington. Presently, there are two manufacturing buildings, one small office building
and a caretaker's house on site. On site paved parking and an access drive from Oravetz
Road service the facilities. Existing Impervious area is 0.76 acres. After development,
1.67 acres will be impervious Fell
The site is extremely "flat", with less than one foot elevation change across too
site, with the exception of a 8 foot levee adjacent to the White River and a 3 foot deep
drainage swale adjacent to Oravetz Place. The site presently is drained by catch basins in
the parking lot that discharge to the Oravetz Place ditch. Other drainage is via sheet flow
off-site, generally to the Oravetz Place ditch. The Oravetz Place ditch exits the site to the
West and then turns North, discharging directly to the White River.
Plan Goal
The goal. of the plan is to treat all onsite runoff for water quality by directing flow into a
wetpond / detention pond before discharge from the site. The detention portion of the
will pond will attenuate for 1/2 the 2 year, 10 year, 25 year and 100 year 24 hour storm
events, with an additional 30% volume increase.
Preventative BMP's
The catch basins shall have stenciled nest to them "DUMP NOT WASTE-DRAINS TO
RIVER". Activity that involves pollutants, shall be done under a covered area. The
parking lot shall be swept as necessary to remove debris

Treatment BMP's
A water quality wetpond has been designed to convey and treat runoff' for conventional
pollutants before discharging off-site.
Inspection
Inspection of the pond and other facilities shall be done on a biannual basis. Inspections
shall conform to the requirements of the attached Stormwater Facilities Operations and
Maintenance Manual. Inspection records must be kept for five (5) years and available
for City Inspector review.

AUBURN RIVERSIDE SENIOR HIGH SCHOOL
For and in consideration of the sum of one dollar ($1.00) and
other good and valuable consideration, receipt of which is
hereby acknowledged, and for benefits derived by the Grantor
herein, the Grantor, AUBURN SCHOOL DISTRICT NO. 408, hereby
conveys and warrants to CITY .OF AUBURN, Grantee herein, a
Municipal Corporation of the State of Washington, its
successors and assigns, a perpetual non-exclusive easement
for the purpose of laying, maintaining, and installing
sanitary sewer lines and appurtenance thereto, said real
property being described as follows:
See Attachment A.
Said Grantee has the right, at reasonable times and after
giving reasonable notice, and in exercising all reasonable
precautions to assure safety of students, staff and public,
enter upon said Easement for the purposes of maintenance,
construction, repair, or reconstruction of the above
improvements.
Said Grantor shall make every effort to not block, restrict
or impede access and egress to and from the Easement.
Grantor may fence across Easement and/or along boundaries of
Easement provided that a gate is constructed in the fence to
allow Grantee access.
