Box 3866/9e evue, washirgton 98009 DECLARATION of NATIVE GROWTH PROTECTION EASEMENT The undersigned, Henderson Homes, Inc„ as owner of Lot 1 of King County Short Plat tnunber 19620, as recorded under King County Recorder's file number 9405170575 and located in the Northeast 1/4 of Section 31, Township 21 North, Range 5, East, W.M., in King County, Washington, now affirms and declares that a non-exclusive perpetual casement for a native growth protection area is hereby reserved and granted over and across the real property described I~ on Exhibit A attached hereto. W~ Structures, fill, or obstruction (including but not limited to decks, patios, outbuildings, or IA overhangs beyond eighteen inches) are prohibited beyond the budding setback line, and within 25% slopes, and within the Native Growth Protection Easement. Dedication of a Native Growth Protection Easement (NGPE) conveys to the public a beneficial interest in the land within the easement. This interest includes the preservation of native vegetation for all purposes that benefit N the public health, safety, and welfare, including control of surface water and erosion, maintenance of slope stability, visual and aural buffering, and protection of plant and animal habitat. The O NGPE imposes upon all future and present owners and occupiers of land subject to the easement bJ the obligation, enforceable on behalf of the public by the City of Auburn, to leave undisGnbed all 25- trees and other vegetation within the easement. The vegetation within the easement may not be cut, pruned, covered by fill, removed or damaged without express permission from the NS Homeowners' Association and the City of Auburn, which permission must be obtained in writing ~j from the City of Auburn or its successor agency. Before beginning or during the course of any s grading, building construction, or other development activity, the common boundary between the easement and the area of development activity must be fenced or otherwise marked to the satisfaction of the City of Auburn.
