BY: /fit I~Q&,°ToA- BY: G Secretary Said Grantor may relocate Easement alignment and improvements therein at Grantor's expense. Completed relocation must be to an equal or better condition relative to original improvements at time of relocation. At no time during relocation by Grantor will water service or access/egress by Grantee be interrupted by actions G required for the relocation without the approved written consent of Grantee. After Grantee's installation of improvements Grantee shall restore, at its sole expense, all improvements and/or property disturbed by Grantee's installation to the condition of said improvements or property to its prior existing condition. This Easement shall be a covenant running with the above-described real property and burden said real estate, and shall be binding on the successors, heirs and assigns of all parties hereto. This Easement will terminate at such time as equal or better improvements are conveyed to the Grantee. Conveyed real property and improvements for water service may not necessarily lie within above described Easement. Any future subdivision of land or design of water system will incorporate the intent of this Easement to provide continuous uninterrupted use as described above to Grantee. e d LU U-1 V W t1_ For and in consideration of the sum of one dollar ($1.00) and other good and valuable consideration, receipt of which is hereby acknowledged, and for benefits to be derived by the Grantor herein, Grantor, THE LAKELAND COMPANY. INC. , hereby conveys and warrants to the City of Auburn, Grantee, an easement under, over, through and across the following described real property for the purpose of laying, maintaining, and installing a DOMESTIC WATER SYSTEM AND APPURTENANCES THERETO. Said real property being described as follows: Said Grantee shall have the absolute right, at times as may be necessary, for immediate entry upon said Easement for the purpose of construction, maintenance, inspection, repair or reconstruction of the above improvements without incurring any legal obligation or liability therefore. Grantee will coordinate all improvements and final alignment of the Easement and installation of all improvements installed therein with Grantor to provide compatibility with Grantor's proposed development of The Lakeland Planned Development District as referenced in the files of Pierce County, Washington as Case No. AA14 - 95. Said Grantee shall have the absolute right to place any type of driving surface within said Easement deemed necessary by the Grantee, provided such surfaces may be replaced by surfaces consistent with Grantor's development plans. Except temporarily as required for development said Grantor shall not in any way block, restrict or impede access and egress to or from said Easement, and/or in any way block, restrict or impede full use of the real property within the above-described Easement by said Grantee for the above-described purposes. Said Grantor may fence across said Easement and/or along the boundaries of said Easement provided that a gate is constructed in said fence. Said gate shall be of sufficient length and location to allow the Grantee full use of, and access and egress to and from the real property within the above-described Easement. If said gate is to be locked, keys shall be provided to the Grantee.
